I'd actually bet that only the pharmaceuticals are holding off until the world is so fucking desperate to have new antibiotics that the world governments would pay any amount of money to get the research done and done quickly, which would sufficiently cover the research costs in addition to the fact they would have to give up the formulation immediate for the public good. Can journalists, news organizations, and comedy shows still be sued for defamation? Of course. A timely retraction backed up by journalistic research (which every credible news organization has) and "genuine" shows of a "honest mistake" will kill any defamation lawsuit as such protections exist to protect the media from frivolous bullshit like this.

So, the question is, did he say anything that was actually wrong?

I don't know if he said anything that was not true. However, the burden of proof is going to be on the plaintiff to prove that anything Oliver said is untrue - and simply saying he ignored certain facts is not a just cause to sue a guy.

Because that's what defamation is, saying false shit about a guy. There is no actual way to sue someone for calling you a "geriatric Dr. Evil" because hilariously none of those words are specific enough; there is no legal language that protects anybody from the things that were said not to mention there is a 100% chance it's going to be backed up by research.

Oliver would actually have to say something highly specific like "he has sex with cats and strangles them afterwards" and stack the statement with "I have proof of it", fail to retract, and THEN fail to produce proof. It takes an epic level of fuck-ups to get sued for defamation; and there's no way Oliver and the HBO people are not prepared for it.

The US government creates the penny at a net loss and the majority of Americans agree that it should just be phased out.
