He specifically said he lied to Chuck to make him feel better about himself. There is no way to prove that the tape is evidence for anything because he can pretend that Chuck is just confused/mentally ill and made a mistake and blamed it on Jimmy.

This shit tape would never hold up in court as evidence.

Jimmy should have gone one level deeper with his trickery after his cell phone got taken apart by chuck and just kept an empty battery in his pocket and showed chuck freaking out about it. It seemed strange to involve Huell like that and can you really plant shit on a witness? Isn't that illegal?
>>
So, Chuck, Kim and Nacho are probably going to die at some point, right?
>>
>>82557843

I dont know much about american laws but wasn't what huell did unlawful? Wasn't admitting doing that in front of the bar asking for trouble?

Jimmy could have asked the doctor from previous seasons to testify that chuck is nuts. Back when he was in hospital she did pretty much the same thing and the words of a medical professional who has treated Chuck in the past would have carried MUCH more weight, wouldn't they?

criminal mischief
>>
>>82558684

>In United States criminal law, mischief is an offense against property that does not involve conversion. It typically involves any damage, defacement, alteration, or destruction of property. Common forms include vandalism, graffiti, or some other destruction or defacement of property other than arson. Governed by state law, criminal mischief is committed when a perpetrator, having no right to do so nor any reasonable ground to believe that he/she has such right, intentionally damages property of another person, intentionally participates in the destruction of property of another person, or participates in the reckless damage or destruction of property of another person.

1) You could argue that the battery could be dangerous for Chuck due to his condition. Technically they did not know 100% his condition was purely mental. And even if it was, it could still be seen as intent to harm him.

I also thought when Kim said "Bingo" they were going to hire someone to steal the tape and doctor it or replace it. When they brought out the equipment to play the tape, I thought Jimmy was stalling because he was waiting for Chuck to get to the room so they could see his reaction when it was a different tape, making him seem like a total nutjob, and then calling the cellphone planted into his pocket and watching him sperg out. lol, I think that would have been better.

Because Jimmy knows that Chuck would never consent to having a charged cellphone battery placed into his pocket since he believes it causes him physical pain. It's kind of like if you think someone is lying about having an allergy to peanuts so you stuff a bunch of cashews into their coat pocket to catch them. You're not a doctor, you can't make medical judgments like that and you don't have the right to place potentially harmful items on someone else's person without their knowledge or consent.

I would say Jimmy could get arrested for harassment and possibly battery (no pun intended, honestly). Battery is touching someone without their permission, and Jimmy knows full fucking well that Chuck would object in the strongest way to having it placed in his pocket.

The whole point is that Chuck does NOT have a disease, and no one has ever proven otherwise. It was him who kept insisting it was an actual condition, the doctors were willing to internate him a long time ago if it weren't for Jimmy. Legally, it's like you said you were allergic to red objects and kept swearing you were and I slipped you a red toy into your pocket. Do you genuinely think I could be prosecuted for that? Besides, what Jimmy did proved without a shadow of doubt that Chuck's not an actual illness, it's a mental disease

Then Jimmy should have brought a doctor in to testify to that instead of violating someone else's space and secretly planting an item that cause's mental distress and harassing the fuck out of them. Also, it appears the people, and everyone else in the room is willing to humor Chuck's fake illness to the point where they remove all devices from the room. Battery can be type of contact battery causes no actual physical harm but is, instead, offensive or insulting to the victim. So what is touching? Touching the person of someone is defined as including not only contacts with the body, but also with anything closely connected with the body, such as clothing or an item carried in the person's hand.

So Jimmy hired someone to touch another person without their knowledge or consent, even though it was just their pocket it is a part of their person, knowing full well said contact would be offensive and cause distress to the victim.
>>
>>82560026
>knowing full well said contact would be offensive and cause distress to the victim.

If I put a picture of your naked grandmother in your pocket and you didn't find it for two hours, wouldn't that be offensive to you? Obviously it caused him distressed, which was clear by the way he recoiled when he discovered the battery. Walt being bad doesn't make skyler good, that's is literally the viewpoint that people who watch too many capeshit movies would adopt.
>>
>>82560104
Someone asked earlier somewhere if it was illegal to plant something in someone else's pocket. I'm arguing that Jimmy knowingly hired a man to touch Chuck without his permission, causing distress by placing an offensive item in Chuck's pocket without his knowledge or consent. This is obviously battery and harassment. It could also be assault, since you don't have to actually physically touch someone to be assault. As soon as you have a reason to fear bodily injuries as a result of any words spoken or any action taken by the assailant, you have been assaulted. Chuck claims that devices cause him pain, Jimmy knew this, thus Jimmy also assaulted Chuck.

>>
>>82560596
The contact did not cause mental anguish.
Mental anguish isn't what constitues as battery anyway, so completely irrelevant.
>>
>>82560309
Half right. The tape set the scene of the crime for the chairmen. Now Jimmy could use the "I lied to make him feel better because I thought his mental illness was out of control" card. All of it, the tape, the battery, the wife, were all just little pieces jimmy knew would get Chuck to crack and freak out and reveal how vindictive and spiteful he is of Jimmy. Which is what happened. Jimmy may have broken the law but everyone in that room knew he was the good guy in that situation on the tape.
>YOU HAVE TO STOP HIM!
chuck is fucked
>>
>Jimmy: Can you reach into your left jacket pocket
>Cuck: 'no' *stays calm*
>Jimmy gets disbarred
>*Curb your enthusiasm horns*
>>
>>82560553
The point was to show that chuck made the recording not because of reasonable suspicion, but because he wanted to take down jimmy.

Alongside this, Jimmy needed to show that his 'admission' on the tape was due to genuine concern for chucks mental health.
>>
>>82560674
it's not irrelevant you would lose cases in court with your autism sperg episodes. it's called building a case
>>
I don't get it. A battery has no current in it so it wouldn't harm Chuck even if he was really sick.

>>
>>82560705

It didn't, otherwise it wouldn't have taken 2 hours and Jimmy's questioning to have an effect.

Stop conflating the contact that would be relevant to battery with Chuck chimping out later because he's a looney. Huell didn't touch his dick or fondled his old man titties or caused any other offense. Neither did he physically harm him. Therefore the contact doesn't fulfill the requirements for battery.

On some level I have to feel bad for Chuck, but it's evident that his mental problem is because of his jealousy for Jimmy getting to be a lawyer despite the hard work he put into it. We've seen the symptoms of his "disease" subside when he comes to terms with Jimmy's success and tries to work with him. On every level his problem is due to the fact he was/is an uptight jealous faggot and it's coming back to bite him in the butt. Jimmy did some wrong stuff, but on a deep level, Chuck is the malicious one.

When you marry someone you give vows. One of those vows is to love and standby the person you are marrying through sickness, heath, good times and bad times. If Walt coking meth was enough for her to shit on those vows then she is the one with the problems.

Walt's underground dealings didn't affect her at all when she started acting up on Walt. He was just coming home late some nights. And she wouldn't have cared about that if he was out at a bar with some mates. She lied on their wedding day, she is at fault.

The underlying cause for many mental diseases is a deep desire for attention, care, and special treatment; Chuck is no exception.

I think what caused his ailment is a number of different things.
A) Chuck's wife left him whom he's still quite in love with.
B) In the end she actually cared quite a bit more for Jimmy than Chuck himself.
C) Their mother preferred Jimmy to Chuck despite the fact that Chuck tried quite a bit harder in life.
D) Jimmy has ALWAYS gotten more out of life, while doing less, by being charismatic and likeable, traits that Chuck does not have.
E) And this is conjecture, but I have a sneaking suspicion that after Chuck's divorce, he became interested in Kim and tried to make a move but was shut down.

So he acts out like a toddler frustrated in life that doesn't know how to get what he wants with conventional means. It's not as though it's a conscious decision.... it's subconscious.

People have never given him the care or consideration that he feels he deserves so he gets it by acting out and getting people to cater to him because of his "ailment".

Chuck is gone for good
He'll probably retire and HHM will be done
He'll either become mega-delusional or have a bittersweet ending with his ex-wife, but don't expect him to be on screen for more than 10 minutes in next season and two episodes in this

What even was the point of having her there? Was it really so that KEK would think it was Jimmy's ace and let his guard down once that topic was over?
