Both an exaggeration on the length of imprisonment and the seriousness of it. I used to work in a magistrate court and its very rare to see someone get charged the full extent of a minor conviction.

If you were ever caught out by something like this, you would likely only receive a fine as a first timer. The only ones who would really go to prison would be those repeatedly doing it despite previous fines and warnings.
