By rule of thumb, Disney would almost always play the "dead parent" over "divorced parents".
It's, belive it or not, much easier to explain and a lot less messy to just say that a character's mother of father are dead, than to get into who has custody of Max during the weekends.
This is something you see used all the time in kids shows.
