Motoko is confirmed a woman, though she's been a cyborg for so long and been between so many bodies that she hardly identifies with that gender for any reason other than familiarity. She even comments about how male cyborg bodies feel "strange" because of the genitals, but she's not upset by the notion. She's just the epitome of 'transhuman' by the GitS definition.

By design. Shirow was a decent writer for the time, and could have been better had he not decided he wanted to become a porn artist full-time instead, and worked on his storytelling. GitS does a fair job of showing several different stages of the human (and nonhuman) condition in such a society, and the Major being "Cyborg: Female Badass" and that's about it is one of the better decisions he made. She doesn't allow anything that shouldn't limit her experience actually do so, and lives as she chooses, while also being bound to duty as the tool of a fairly oppressive state; a deliberate irony.
