minecraft merch came out in 2011. was still in dev in 2009 and i doubt some kid made a minecraft creeper hat and was in the know of small indie games still in dev. so this leads me to believe you were 8/9 in 2011 earliest. but since the photo seems to be taken on a smart phone with half decent camera quality, which is uncommon for 2011. This brings me to estimate that this photo was taken in 2011 earliest.
Bringing me to the conclusion that you are underage because to be 8/9 in 2011 you would have to been born in 2002 which means you're either 14/15 or if you're born earlier 16 years old.
