I'd often switch out an empty pot for the half full one while it was still brewing so I could get coffee to my customers that much faster. It's really, really not unnormal for coffee to be 190 degrees in the customer's hand. Yeah it's hot, but she somehow failed to cool down after 15 entire seconds. The whole claim was that they should cool it down to another temperature that would've taken 20 seconds. Okay you seem to be misunderstanding my point. It's harder to find fault in a criminal trial due to the stringent rules regarding what allows a conviction. The rules of evidence and the standard of evidence for example. Saying "well OJ got off how are courts always right?" is a strawman of my position because I never said that. We're talking about civil litigation specifically. In civil litigation, torts specifically, certain parties have a duty of care. This is what is being discussed. McDonalds has/had a duty of care to ensure its practices were congruent with patron safety. This has nothing to do with the OJ case. It's completely irrelevant. It seems like your lack of knowledge is what is stopping you from being to ascertain why pointing this fact out is an apt counter-argument.

Just another question, though. Can the rules of evidence, as you mention above to the other guy, be imperfect/biased so as to manipulate verdicts in different favours? For example, witness testimony. If you get enough people to confess to some event or person occurring/being guilty, you can win.

Because of my above proposition, arguing whether a court case is a tort or a criminal case is null argument, any verdict reached is not the final argument, no matter the types of evidence used to acquit or indict a defendant. The court system is not a hermetically sealed dialectical chamber, it is tainted by bias, bribery, and pandering. You're arguing with someone who studies truth and the validity thereof as a serious interest.

Is exactly what I'm talking about, the type of case, the evidence provided, the stringent rules or lack thereof needed to to indict a defendant DON'T MATTER TO THE CONCLUSION OF A DEBATE ON THE VALIDITY OF A CLAIM.

I used the OJ analogy to demonstrate how just because an argument ends in the courtroom, the verdict reached has no bearing on the actual validity of the argument, not whether "courts are (not) always correct in their verdict". Again "duty to care" for a patron doesn't matter, the legal or moral obligation of a cooperation doesn't matter to the debate I am having at all. I'm not arguing the verdict reached in the Liebeck v. McDonalds, I'm arguing the effect of the decision reached in a courtroom on the overall dialectical process of discerning the validity of an argument.
