In theory, there's no reason why US obscenity laws couldn't be applied to take down a website hosting guro, as there is no intrinsic value (artistic or otherwise) in guro other than for reporting purposes. And, as much as /pol/ would like to think otherwise, 4chan is not a news agency or body for spreading official news, which would easily stifle any argument invoking the 1st Amendment.

Albeit, it would take a truly authoritarian streak by the government for 4chan to be seized or forced to remove guro by court order, although not outside the realm of legal possibility.

That's the problem with obscenity laws, they hinge on "artistic value". So, because loli and porn are considered artistic, they're completely legal to own. But, if a court decides X isn't artistic it can become illegal until overruled by a higher court.

Again, it doesn't necessarily matter what you and I find artistic or not if a court decides otherwise. And, I'd wager that a layman or judge probably wouldn't see the inherent artistic qualities of guro, since there will ultimately be someone showing them examples which may or may not be biased to force a certain decision. And even then popular approval for guro would be pretty low in a hypothetical ruling anyway, since the 1st Amendment would still allow news organizations to show guro for reporting purposes.

If stores in the US are allowed to sell a movie in the Saw franchise then it shouldn't be illegal to share someone's fan guro artwork on an internet forum.

Horror movies are actors being killed in a convincing fashion. Guro is the same with drawings.

This guy gets it. In the 1900s, "smut" (porn) was in danger of being outlawed during the whole abolitionist movement, but the courts ultimately ruled that porn is artistic. In the future, however, there's no reason that this ruling couldn't be challenged making porn illegal. I in no way support obscenity laws, but it's important to understand how they work, because in the framework I laid out, it's entirely possible that guro, gore, porn, loli, etc could be deemed un-artistic and thus be made illegal. The US really likes authoritarianism, just when no one notices.
