Nothing that hasn't been said before but the police don't get to go above federal law without a warrant.

This cop abused his authority and it seems that he was used to doing so. It says a lot about our current system. People are terrified of going against a cops orders, as they'll be thrown away for obstructing justice or resisting arrest or obstructing a federal investigation. These 3 charges are almost exclusively used to strike fear into the populace and encourage them to comply to all demands by the men with a badge.

It reeks like an entire police system that has been given too much leeway and unchecked power. It might be time to slap some serious limitations on law enforcement to make them into the civil servants, not lords, they're supposed to be.

Police Department and hospitals set up a policy which is clear about drawing blood from patients.
About a year later some officer is completely ignorant to the policy and has it shown to him in writing and had it explained to him.
He doesn't know what to do so he calls HIS SUPERVISOR (not sure why you guys are confusing that part with her supervisor) for how to handle it.
Supervisor tells him to arrest her. She gets put into cuffs and put in the backseat for about 20 minutes until the Hospital Attorney comes in and shuts that shit down immediately.
This isnt some legal aide that googles law. I'm thinking you guys are completely misunderstanding how in depth a hospitals Legal Dept is.
Now the nurse is working. The officer on scene and another unamed officer (most likely the supervisor that advised arresting her) are on administrative leave while a criminal investigation is underway.
The chief of has apologized formally to the nurse and hospital staff.
The police department has immediately started retraining its officers on Blood Draw Policy.

They've basically admitted guilt. The nurse is suing and even the unconscious guy who the cop was trying to draw blood from should sue for violating his rights.

WE NEED NEED A SOCIETY FREE OF POLICE

Also, HIPAA is about protecting "PHI" (patient health information). Transfer of PHI from a hospital to Law Enforcement is HIPAA compliant as long as the receiving entity can be understood to protect the information it receives. Law Enforcement, Lawyers, and Federal Agencies are generally assumed to protect PHI, otherwise no patient health information could be transferred to them at any time.

HIPAA isn't specifically about giving individuals rights to privacy. It's broadly about maintaining security of records so they aren't stolen/disseminated/sold/misused/etc.
