From what I can tell the cop is probably going to get away with it. It just about every state the police can request a blood draw be taken and sent to the lab, but the results of that test are sealed until a warrant is provided. The draw is not protected by search and seizure, only the results are as far as being admissible in court. This is fairly common since any drug or alcohol in the blood continues to degrade the longer you wait, so the courts allow immediate draw if it seems likely a warrant will be granted upon later request.

That nurse was on the phone with the head of the department, head nurse, an administrator, or someone well above her pay grade, and was waving around some sort of agreement she was talking about with the officer, so there is also some sort of extenuating circumstances here as to why she's refusing to do it that can't be determined by the video.

Box of donuts says they sue, and the cops give her $20-30k paid out of the city's insurance policy, the whole thing is wrapped up under a "no fault" agreement. She gets paid to shut her up, legally cops admit to no wrongdoing. Business as usual.

I said it before in this thread, but I'm not sure I got my point across as well as I could've. It's about accountability. Cops do this shit on occasion because they have almost none.

I'm a general contractor. I hold a builder's licence. If I were to say, build a deck, and not pull a permit on it. Then the deck falls down, killing people, I would face very stiff penalties over my ineptitude. Much stiffer than if just some guy, with no licence built the same deck, and had the same thing happen. Knowing this did not dissuade me from becoming a building. It FORCES me to do the job right, because I know the penalties if I cut a corner.
