You cant make a determination without direct comparison of the two.

Its a somewhat interesting because it speaks to the heart of what is transformative in a video context. Can editing alone be enough to be transformative to a work? I would argue it can, but will the court see it like that? We will have to wait and see

Yeah sorry, the only place i found "transformed" at https://www.copyright.gov/title17/92chap1.html#106 was when defining "derivative work".
Well it's going to be tough either way I just read about https://en.wikipedia.org/wiki/Cariou_v._Prince which was really minimalistic in his transformation as well, but held up in court.
