I been years on large cargo boats, the rule is simple.

1. There is a give-way and Stand-on vessel
2. Stand on vessel maintains course and speed, while give way vessel changes course.
3. If the Give way vessel isn't doing there job, the Stand on vessel tries to go to starboard to avoid the collision.
4. If a collision happens, and it not one of the 4 exception (Fishing, towing, and the like) Rule 17(d) is hyper clear that the give-way vessel is at fault, no matter if the stand-on vessel attempted to go to starboard or not.

It really simple, and if you can't understand that you will never be a master of a boat.
