"Hate speech" is the reason "free speech" laws were created: to protect unpopular opinions. Hate is subjective. People who don't respect free speech are the worst kind of tyrants in the world. The problem with the whole "hate speech" thing is that it is difficult to determine what is hate speech or not. The definition and interpretation varies across the political spectrum (and even within the same position).

Forgive me. I should have said "falsely yelling fire." I assume every states laws is written similarly, and so altering people to a dangerous situation is never a crime. The fire thing comes from a SCOTUS case in the 20s, where some anarchists (?) Yelled fire in a theater to cause a panoc, and asserted that the first amendment barred the state from prosecuting them. The court sided with the state, and while it may have been the correct way to go in that case, it began a precedent of classifying and limiting speech under the first amendment.

Other countries have created and defined the term hate speech, and the definitions and punishments vary, so it's not actually a static thing like you're making it out to be.

You're confusing the concept of incitement with speech. Incitement into a dangerous situation doesn't require speech, it could be trickery of other methods. It's not illegal to shout fire in a theater nor should it ever be in the case of fires or mistakes thinking there's a fire. If it's determined shouting fire was intentionally fraudulent with the motive to incite wild panic then the person would be under a different type of penalty. Not because of speech by itself.
