Google employment blacklists -- may be illegal in CA

This is a red board which means that it's strictly for adults (Not Safe For Work content only). If you see any illegal content, please report it.

I've noticed some shitlib Google employees boasting about creating internal blacklists for people whose political opinions they don't like. Pic related.

>The Labor Code (§1050-1053) specifies the following acts as blacklisting:

>Preventing or attempting to prevent former employee from getting work through misrepresentation.
>Knowingly permitting or failing to take reasonable steps to prevent blacklisting.
>In a statement about why an employee was discharged or left employment, implying something other than what is explicitly said, or providing information that was not requested. Furnishing information without a special request is prima facie evidence of a violation.

>California laws prohibiting Defamation
>Defamation occurs when a false statement is given to a prospective employer that damages the reputation or economic interests of that person. Intentional defamation can also lead to blacklisting claims as well. A former employer is only free to state whatever they know to be factually true about an employee in references.
>If a former employer is “blacklisting” you with direct slander and falsehoods you may also have a claim for defamation. However, they can contend it is an opinion, and opinion is a defense to defamation. Therefore, the blacklisting laws may be more helpful when their purpose is to prevent you from ever working again in your chosen trade, occupation or career.

Depending on the exact circumstances, this particular woman may be in breach of California labor statutes, especially since she is sharing it with people outside of the company. I imagine this practice is widespread -- it would be great if people could find more examples of idiots bragging about it.

Here is what might be illegal: sharing such a blacklist with someone who is external to the company, with the explicit intention of denying someone future employment for their political beliefs. Even if this one doesn't meet the threshold of illegality, I'm sure there are other examples that do. This could really help out Damore's legal case if they're being so brazen.

Looks suspiciously like a systemic power structure.

Interesting. I'm gonna do a little looking into the law out of curiosity.

It does appear the leftists at Google have become so comfortable and arrogant in their belief they have the power to blacklist others and control their future career opportunities that they openly boast about it and thus violate labor law. Hopefully this case marks a cultural change

The point of archiving their shit is because it will give proof that the screenshot isn't photoshopped. Also that bitch blocked me I don't know why probably because i've been blacklisted too by a big tech company

Ding ding ding. Bingo.

Damore legal action should be looking at:

(1) Libel and Defamation claims (against individual Google employees highlighted in screen caps passing around), AND through doctrine of Respondeat superior (codified in California Labor Code Section 2295), which makes the employer liable for the torts of its employees, apply this to Google itself,

(2) Intentional and/or negligent Interference with Contractual Relations (for all attempts to prevent him from gainful employment post-termination),

(3) MAYBE some NLRB (labor law protection) violation, but since he wasn't making these comments in combination with attempts to organize a Union, he's got uphill battle here.

(4) Intentional Infliction of Emotional Distress (vs individual Google employees and Google itself)

(5) Breach of Contract (to the extent he can prove Google policies purport to protect his free speech rights)

>>136633911

I don't want it to be against the law.

In the U.S. wrongful termination laws do not prohibit you from firing people based on political beliefs.

In this instance, Google has fired an employee for complaining about gender discrimination. This opens the door to fire individuals for promoting feminism or diversity in the workplace.
>>
>>136635229
We're not in a position to be firing anyone though, so it's in our interest for it to be illegal.
>>
>>136634936
ARCHIVE EVERYTHING
>>
>>136633911

Also - suprising this hasn't got him fired. Google has some incredibly lax standards. He's openly saying he will damage the business because of petty office politics.
>>
>>136635014

Since he was talking about NRLB retaliation in his responses to the press, I assume he lawyered up days ago (if not before he wrote the memo). He also seems to have some PR help. Did he hatch the whole plan ahead of time, or did allies swoop in to help him when things got fraught?
>>
>>136634936

>This opens the door to fire individuals for promoting feminism or diversity in the workplace.

No it doesn't. Big tech companies are thoroughly infected with globohomo ideology .. it seems to be a feature of any large organizations nowadays, be they public or private. The left EXCELS at infiltrating and subverting existing institutions, boomer CEOs don't know what's hitting them. Making it explicitly legal to fire people for political beliefs would hurt us, not them.

political beliefs are only lightly protected by a few places, unlikely to go anywhere.
using or furnishing a blacklist against someone for any reason is what's mostly illegal in CA, it's difficult to enforce unless you're stupid enough to admit it. the goal is to prohibit people from selling lists on the open market I guess

I think he planned it ahead of time. I've been re-reading the document, and the more I do, the more I think it's a work of genius. It was the perfect mixture of totally innocent "look, here's what the data says" with uncomfortable conclusions, that seems DESIGNED to provoke precisely this shitlib outrage while being completely defensible to normies (and in court). He covered every angle, said nothing the slightest bit rude, and presented it as both a complaint about discriminatory practices (stick), and as a way to help the company (carrot).

Plus we know he put in a complaint with the relevant government authorities before being fired. Maybe not 4D chess, but 4D checkers at least.

There's another aspect of this that we need to address, which is pushing back on the normie-conservative kneejerk "they're a private company so they can censor whoever they want". It's an unthinking ideological MUH FREE MARKET response that gets conservatives nowhere, and the left never sticks to it anyway (look at how they still whine about the Hollywood anti-communist blacklists, despite those being done by private entities).

There is in fact precedent for regulating private monopolies so that they respect Constitutional rights: Marsh v Alabama:

https://en.wikipedia.org/wiki/Marsh_v._Alabama

>Marsh v. Alabama, 326 U.S. 501 (1946), was a case decided by the United States Supreme Court, in which it ruled that a state trespassing statute could not be used to prevent the distribution of religious materials on a town's sidewalk, notwithstanding the fact that the sidewalk where the distribution was taking place was part of a privately owned company town. The Court based its ruling on the provisions of the First Amendment and Fourteenth Amendment.

Basically if you have a de facto monopoly and it starts to take on quasi-government roles (which Google and Facebook are certainly doing now -- read Assange for more details on this), then precedent deems them responsible for protecting constitutional rights on their platform. I would love to see this argument made in court, which to my knowledge it hasn't yet.

That, plus the obvious case for antitrust scrutiny, should help us cut these monstrously large tech entities down to size.

This is an interesting thread that raises an interesting topic. Where and how is the line drawn between public and private utility and interest. I've always seen the internet as a public utility or space while private companies like Google or Facebook operate as private vendors inside that space. Think of those private companies like food trucks or hot dog stands parked and operating on a public street.

Why is so much of the public hesitant to view internet companies as...companies? If standard oil can be a monopoly then why not Amazon or Google?
>>
>>136636110
From a legal perspective the way he frames it is interesting:
1) he emphasizes discrimination against political views, which is a protected class in california state law
2) the ostensible point of the memo is to discuss diversity policies, and employees are protected from retaliation when discussing employment practices (even if they are wrong)

>“I would see a young woman who was very attractive, and a thousand times smarter, and she’s living in this little tenement hovel with her husband, Ralph, and then this Ed Norton, who has an even hotter wife,” Mavis told me. “These men spend all their time talking about what a drag the wives are and asking how can they get away from them. It’s perfectly obvious the women are the ones trapped.”

>“I remember telling my mother when I was 7 or 8 that I was never going to get married or have children,” continued Mavis. “To me, this is the way women get caught.”

I think part of it is that internet companies are more ephemeral by their nature. They flash and fade so quickly that it can be difficult for lawmakers to catch up, and boomers don't understand the technology very well anyway.

I haven't kept up with net neutrality politics for a few years, but I'm willing to bet that the term has been perverted into all sorts of lefty nonsense (MUH TORRENTS etc). It doesn't help that cuckservatives and libertarians are against it for stupid ideological reasons. If rightists put their voices on it, it could morph into something genuinely populist and anti-consolidation, which is the real threat to liberty anyway (either by government or by corporations).

Very well put. Very well put. Especially the portion about threats to liberty coming from public OR private interests. In the US we've always defined liberty as "freedom from..." instead of "freedom to..." I think people are slowly waking up, in the younger generations at least to the reality that a private interest can usurp your liberty or constitutional rights, or at least attempt to do so, as easily as government action.

>the normie-conservative kneejerk "they're a private company so they can censor whoever they want". It's an unthinking ideological MUH FREE MARKET response that gets conservatives nowhere

This your reminder that authentic conservatism is a moral position, not an ideological position. So called "ideological Conservatism" is actually just a rebranding of classical liberalism, and it's proponents are just leftists in right-wing drag. Authentic conservatism is the assertion that your culture, people, and way of life are moral goods worth defending and promoting like any other moral good. For example; the original creed of Superman was an authentically conservative formula. He fought for "truth, justice, and the American way". Truth and justice are moral goods, and "the American way" is given equal status. If you aren't willing to put aside an ideological principle for the sake of preserving your people and way of life, then you aren't actually a conservative.

Right ... another example are banana republics. United Fruit was so rich and powerful that it could bully the weak governments of various Latinamerican states into doing whatever it wanted, to the detriment of the inhabitants. The East India companies are another example.

Past a certain level of gigantism, the distinction between public and private is just a formality. People everywhere miss this: the threat is not governments or corporations, it's the consolidation of power and SCALE in all forms. It isn't a coincidence that the happiest, wealthiest and healthiest society in Europe (Switzerland) is aggressively localist and protectionist, to a degree that can verge on pettiness.

(continuing)

Not that anyone still cares, but this episode should conclusively debunk any NRx spergery about how tech corporations will lead us into a glorious future of decentralized libertarianism.

A tech behemoth was so rattled by one minor bland dissident in its own ranks that it had to initiate a witch hunt, with ensuing struggle sessions for everyone else, to restore the peace. If Google was a government, we would call this Maoism, and therein lies the problem: as Google takes over our e-mails, our cars, our news filtering and who knows what else they want to do, they increasingly become just that, a pseudo-government, and not exactly a libertarian one.

A lot of these tech companies matured in an age where hands-off capitalism was seen as the wave of the future and it clearly went to their heads. They think it is incumbent on them to curate the worldviews of their employees (and clearly they're going after the customers as well) and to maintain "a culture", as if a company the size of Google could ever be one monolithic block of true believers.

We complain a lot about governments cracking down on speech, but even comparatively repressive states like Britain or Germany are girl scouts compared to these fanatics. They have the data to issue comprehensive proscription lists and you better believe they would if they could get away with it.

Jews still think you can solve the problem with talking, because Jewish culture has been defined by Rabbinical discourse for 1500 years. Whites are better at seeing long term consequences than Jews, and recognized the problem wasn't going to be resolved via discourse a long time ago. The whites have given up on discourse and are buying guns. Whites have gone quiet, and if you know anything about history that should tell you shit is going to get ugly soon.

I guarantee you there are dozens, if not hundreds of white men at google who could have written what Delamore wrote, but they knew it would get them fired. Instead they decided to make some money at Google, while earning the cache associated with the google brand, and then split after a few years to start their own businesses as "former google engineers".

With $1,056,500,000 in gross revenue in 2015, the firm placed 25th on The American Lawyer's 2016 Am Law 200 ranking. Am lawyer. Not a califag though

Its not necessarily defamation if they're stating an opinion (i.e. they are "hostile" voices). Opinions cannot be the basis of defamation.

I know california has more employment discrimination protection that most states, I am not sure if political beliefs are included and don't feel like finding out since I'm never going to/practicing in that shitty state. If political beliefs are protected under their employment discrim laws, google broke the law. However, it is worth it for google to pay this guy a settlement versus taking negative press from MSM. Can't buy good press, but you can pay for it to go away.
>>
>>136633911
lawyer here.

best bets for having a claim are either the political pre-screening is tied to a fundamentally protected right, like religion.
i.e. your motive is to discriminate against political beliefs, which is technically legal, but they effect is to ban all conservative christians from the workplace, which is not Constitutional.

The other claim would be good old fashion defamation. If you're impacting someone's chances to be hired by publishing lies, i.e. you're a sexist fascist racist, and there's no claim to back that up its defamation, or slander. I can't remember because my state combined the two years ago so they're the same thing.

This is the problem liberals don't see coming. Outside of the crazy 9th circuit, no one can prove that what the google guy did counts as actual legally recognized racism/discrimination etc.

Political belief is protected.
What he did likely doesn't qualify as political belief, but as a controversial statement which is kinda protected but not nearly as strongly.

What is defamation by any reasonable understanding is the willful misrepresentation of what he said to such a degree that it paints him as an unrepentant sexist/racist.
>>
>>136650709
its really never been done in this context but what do you think about claiming just straight racial discrimination?

it probably won't get strict scrutiny because its straight, white males, but you might be able to slip it under intermediate and compare is to the VMI case with the military schools separated for men and women.
>>
>>136631353

>>136650709
Just a note, almost no states have political belief protection in their statute. I'm in a deep blue state and even we don't have it.

>>136650760
>>136651235
You won't get strict or intermediate because Google is a private company bro. Its all statutory in these situations. I've brought race discrim claims with next to nothing to prove it, so yea he could totallymake a prima facie showing (assuming Cali if like other blue states with lax pleading requirements).

If this was a government employer, it would be rational basis. I cannot imagine putting what the media is assuming to be a white male in a protected class.

>you're a sexist fascist racist, and there's no claim to back that up its defamation, or slander.
Those are opinion statements m8. Easy way to "back them up" sufficiently - any of the news reports talking about the memo. Defamation claim loses its legs imo

If Google was a government, we would call this Maoism, and therein lies the problem: as Google takes over our e-mails, our cars, our news filtering and who knows what else they want to do, they increasingly become just that, a pseudo-government, and not exactly a libertarian one.
Couldn't sum up this whole situation any better.

Wow. Looking at this Kelly Ellis character..... she is a law suit waiting to happen. Is she at Medium or Google right now?

Doesn't really matter, though if she's at Medium....

If I'm James Damore's attorney I'd be looking to sue to Medium also. For tort of Intentional Interference with Economic Advantage (Medium gets to answer for the torts of its employees). Sue Medium, start discovery, find out of Kelly Ellis has anything to do with hiring there, and find out of she shared her "blacklist" with anybody else in the industry...

>Not that anyone still cares, but this episode should conclusively debunk any NRx spergery about how tech corporations will lead us into a glorious future of decentralized libertarianism.

It won't be the corporations that do lead us to decentralized libertarianism, it will be the reaction against their tyranny that will. It takes a corrupt and tyrannical Google for there to be demand for alternatives that are decentralized.

How can you repeal women's suffrage when 50% of the population is women and another 30% are white knight faggots? It's not going to happen. Which means women (and jews) will rule until everything goes to shit in a long slow collapse, at which point there may be a civilization reset, but that would probably be tied to some sort of global event like an ice age or massive volcano eruption, etc.

Just look at her Twitter feed! She's openly discussing a "blacklist" and sharing it with others. In the context of wherever she now works. When you are an employee and go on twitter discussing employment actions (making a blacklist of "bigots"), you are speaking for your employer whether they have authorized you to do so or not.

If she now works at Medium, and on behalf of Medium is now discussing blacklisting people in her industry as sexist, bigots, etc., then Medium gets to answer for that, if that = a cognizable wrong under applicable statutes or common law.

Could be an interesting case. I hear these SJW saying "speech has consequences" all the time, but they seem to forget that intentionally trying to end someone's livelihood is an actionable tort under the laws of most (all?) states. In your garden variety social media storm, you're dealing with potential defendants that don't have deep pockets because they are individuals.... But that doesn't mean there isn't an actionable case. Find a deep pocket and an actionable wrong, and the attorneys will come out of the woodwork to vindicate the right.

The left has been engaging in "law fare" for years. The right would be smart to open up the law suit spigot on all of this shit. Now, California has some crazy laws like the SLAPP laws that may create attorney fee liabilities for people that lose these suits, but other states don't have that.... and there are PLENTY of jurisdictional options to any smart litigant.

>>
And for other Google employees who agree with Damore, if they were smart they would tomorrow form an internal Google group and publicly declare they are organizing to form a Union at Google. Once you are "organizing" for a Union, you get to talk loud and proud about work conditions and Google can't fire them without running afoul of the VERY pro-employee protections under the NLRB. Those protections are the result of 50 years of hard-core leftist attention and the NLRB have not, to my knowledge, ever been wielded by the right against the left. This Google thing appears to be a PRIME opportunity.... All you need is 30% of employees to agree to Unionize, and the internal Google poll I saw the other night showed 20-something % of Google employees agreed with Damore.... Conservative employee union at Google would be EPIC and a game changer. If it worked there, the Union would grow nation-wide like wild fire and then break out the pop corn as the left realizes their carefully laid NLRB plans have boomeranged in EPIC fashion.

>>
>>136634936
This whole crusade can be turned around on them.

Google knows these "lists" and this vigilante justice these SJW's are looking for is really bad for business, all the way around.

Right now it seems like they have been successful and the industry is behind them. It's not. Very few companies will ever want to expose themselves to the liability that comes with hiring someone who creates that kind of friction and animosity.

Only piece of shit progressive companies like MOZ will publicly court them, and even then that support will quickly fade as it starts to cause problems for these companies.

There will be an unspoken blacklist, created by common business sense, that says don't hire people who hold grudges and maintain Orwellian lists of coworkers.

This list making needs to be a focus and it needs to be attached to their names as much as possible. Every pre-employment search will reveal their blood lust and make them persona non grata for all but the lowest of tier companies. Two star G2Crowd ranking companies.

Remember basic SEO. Their names in titles and image with commonly searched related keywords.

She is at the top, so of course a lot of the searches will be headlines from major outlets. Those are damage enough.

Those are good things. Most of the business/tech world is not filled with sniveling SJW's. They may have to keep up appearances, but leadership knows this shit is cancerous to innovation and growth.

This is a technological conquest. Companies concerned (genuinely) about feelings don't last.

We need to make sure that the smaller ones, the ones spreading the internal lists, the ones replying to her twitter asking for the list, everyone in the screenshots, those are the ones who will slip under the radar.

Those are the ones who's name needs to be tied to this as much as possible.

I've been on the inside of enough hiring to know that shit like this is cancerous long term.

I've seen dozens of candidates turned town due to controversy smaller than this. Of all races and genders, because of the assumed trouble they could potentially cause.

I'd like to know what what Sundar Pichai (CEO) and.....ahem..... Danielle Brown (VP of Diversity) and other management persons involved think of ADAM FLETCHER and the many other Google employees here in /pol/ identified, who are IN WRITING and IN PUBLIC (inter Google or what gets out Here) threatening other employees who don't engage in GroupThink.

Many of the SJWs in Google were taunting leadership to "mean what they say" about promoting Diversity. So, fire that guy, and indeed they did.

Ok. What about it Sundar and Danielle? Do you "mean what you say" when you say Google is open to all points of view? We here at /pol have Grade-A Evidence that a whole bunch of employees aren't on board with "what you say you mean."

Like James Damore, should these other offenders of Google policy in your midst be summarily terminated from employment?

Just wondering....

Holy shit --- The script for this whole affair fucking writes itself:

We need some current Google employee to come foreword tomorrow and challenge the whole "People must feel free to express dissent" decree today from Google CEO, Sundar Pichai.

This employee should demand the immediate termination of all Google employees that have made overt threats against other employees based on dissenting viewpoints.

Of COURSE Google won't do that, and instead the mob at google will -- even if I waved this post in front of them before all of this --- go absolutely ape shit crazy about working with this brave soul and demand his ouster.

He then claims "constructive termination" by Google because they he can't do his job on account of being black listed.

Then he starts the MOACA against Google. MOACA means the Mother Of All Class Actions.

BOOM. Your welcome.

For one thing, if the MSM keeps calling it a "anti-diversity manifesto" then everyone will just roll their eyes and dismiss it as sexist crank writing.
