Why is legislation prescriptive (i.e. like a checklist) rather than objective (i.e. goal based)?
I mean think about it, it makes the people obliged to actually understand a fair deal about what is legal and it further stimulates them to promote certain values or seek certain goals.
It reduces the prescriptive "trap" of legislation by making the law more malleable. People have to think about why the law is there rather than just obey the law.
And it reduces the amount of legislation required to "set out the law". It would be a solution to our current overly legislated system. It would also let us cope morally in this "secular" society we have.
