What do the Laws Prohibit?

Conduct that may be penalized under the TRA and/or prohibited under the EAR includes:

- Agreements to refuse or actual refusal to do business with or in Israel or with blacklisted companies.

- Agreements to discriminate or actual discrimination against other persons based on race, religion, sex, national origin or nationality.

- Agreements to furnish or actual furnishing of information about business relationships with or in Israel or with blacklisted companies.

- Agreements to furnish or actual furnishing of information about the race, religion, sex, or national origin of another person.

Implementing letters of credit containing prohibited boycott terms or conditions.

The TRA does not "prohibit" conduct, but denies tax benefits ("penalizes") for certain types of boycott-related agreements.

The only thing this law does that the 1977 anti-boycott law doesn't is that it includes the UN with "foreign nations" that are not allowed to organize boycotts in the US. And it only applies to corporations, not private individuals. The UN was not even leading a boycott so it's virtually pointless.

A pretty much identical version of this law has existed for 4 decades and a bunch of dopey politicians want to beat their chests by either supporting or condemning a new version that makes mention of the UN. This whole thing is a big waste of time for everyone involved, both from the people who wrote the bill and the people who are fighting about it.

The hill to die on would have been in 1977 if you wanted to have an argument about whether or not corporations should be allowed to boycott a US ally. Instead we are going to get yet another redundant law where the supporters will pat each other on the back despite having done absolutely nothing, while the detractors will scream that it's the end of democracy while ignoring the fact that they've been living under an almost identical law for 40 years.

The UN isn't pressuring American corporations to boycott Israel, and this law will not throw you in jail if you decide not to refill your soda stream cartridge. The only way to come out of this not looking like a fool is by not picking a side. People on both sides are arguing about a stupid "symbolic" piece of legislation without actually understanding it, and meanwhile nothing useful gets done in DC, as always.

if it was "virtually pointless", why have all the penalties been drastically increased? If a law is illegal, and has been passed, does that mean it cannot be challenged? If a law is useless, why should it be passed at all? If a law is useless, illegal, and has no point in being around, why even let it pass at all if prison time and monetary fines are threatened in cases of "pointless" violation? We have enough "pointless" laws on the books as is, there is no need for any more useless legislation, especially illegal laws, if the law truly has no point.
