Judiciary system is the last element of power that wasn't cleaned from communism. In normal countries like USA president elects high judges who are the best of the best. Currently in Poland judges elect themselves so it became some sort of cast because they elect their people. Current government changed it so the parlament chooses the judge. People who protest it are libcucks like 'Never Trump'. Those judges aren't even people with high morality so there is no reason to defend them. They served previous cuck-government.

PiS is not really my party but people who say we don't need reforms in judicary system are morons. Most of those people don't understand and can't explain against what they protest

So apparently they want to not only select the judges directly (as opposed to through some elaborate system that ensures no single government can replace the entire judicative) they also want to remove all the judges (which goes against the constitution). That's not exactly a dictatorship already, but it sure smells mighty fishy.
>>

>>
>>134451157
Well yeah. The supreme court usually does sane rulings. However things seldom go there as they primarily do rulings on rare cases where the lower courts arent sure what to do.

The judges only sit for one year at a time however which is retarded.
>>
>>134451181

This guy explained really accurately what this protests are all about. Those demonstrators are nothing more than pigs squealing, because finally someone tries to destroy this cliques of corrupted judges established during communism. The other portion of these scumbags are just useful idiots, that hate current government, and they need any reason (even most retarded and illogical) to protest. they scream about democracy dying and tyrrany being established now, while they can protest legally, and no actions are taken against them by police etc. It's the same situation, as in USA with Trump. The establishment is fighting for its corrupted system using idiots and traitors against legally elected government, that tries to destroy them. I do not support PiS, they are rather far from what i would like as ruling power, but they did 100 times for country in 2 years, than previous government full of criminals and shady types during 8 years of being in charge.

The new government weaseled itself into three more seats on the constitutional tribunal. This was after the previous government tried the same with two other seats. The court decided it wouldn't have it, the government told them to shut up and now nobody knows wether the tribunals ruling are legitimate or not.

Our constitution (the inalienable rights and customs of the people) has been enshrined in law since alfred the great, and existed before history was recorded.
In 1649 we cut the kings head off after 500 years of rebellion because he thought he was god and we thought we were free men.
1649. Where do you think the american settlers got their ideas from?

no dickhead. A constitution is a declaration of inalienable rights. Yours was directly lifted from the bill of rights, magna carta and several other documents.
ALL of those documents were merely legal acknowledgements of the rights that our men (and yours faggot) fought and died to ensure were never lost.
You fundamentally misunderstand the concept of law. You still seem to think it is things that your rulers gave to you. It's not. it comes from a time when our rulers only ruled over a few hundred men at a time and needed them to fight against their neighbouring tribes, so they HAD to respect their rights, they all had swords. The very reason laws existed was to keep the rights of men inviolable and to ensure justice and therefore peace amongst men.
Our rulers were our rulers because they were good at ruling, not because they were gods. They did not have the right to take rights from anyone else, they were just leaders.
That's where your constitution comes from, that sense of freedom.
We lost this in 1066 and regained it in 1642.
Your constitution was directly lifted from the ideas of those men in 1642. There is no argument to this, only your ignorance.
The jamestown settlers were 1609. Where do you think the notion that they were free men came from, despite the fact they were English?
So all the early settlers came from England, where they had just killed the king, and you think the idea of the sovereignty of the people rather than the king came from america?
You then wrote the french declaration of rights and it passed to the rest of europe in 1848.
But the only reason you ever had that sense of indivdualism is because your founders were english. Or british, as the welsh and the scots and the irish have ALSO fought to be free men since before history, only they were mainly fighting against us...

Minister of justice is also attorney general or whatever it's called in English and now he will also decide who's in supreme court. He can also tell judges what should be the verdict on each case and if they don't agree he can remove them. Basically whole judiciary will be decided only by currently reigning party, effectively making us no longer be a democracy. They are also removing everybody in current supreme court and will elect a new one. They don't care about term of office, they just make a new resolution whenever they feel like it and remove people from their office, replacing them with their supporters. The reigning party (PiS) keeps ignoring the constitution and just make resolutions that directly contradict our constitution claiming "not really" or "we're doing it for the people, constitution was bad". This way they can illegally push whatever resolution they want. They just pretend no law was broken and when people quote various articles that were broken they simply ignore it.
It's honestly retarded but the person currently ruling the Poland is mentally ill. It's impossible to reason with him.

Don't listen to this retarded shill paid by PiS:
>>134455443
>It's really only a small group of people.
In reality there are hundreds of thousands of people. Every single city is full of protesting people of all ages. Big cities (>0.5m) have at least 50 000 gatherings, some probably over 100 000. Even smaller cities with like 50 000 people total had hundreds or thousands gathering in the streets.

Minister of justice is the one who selects them. President can only say yes or no. However he always agrees to anything by PiS so it's a moot point.

>Current government changed it so the parlament chooses the judge.
So now they will become a cast of current government. Awesome. In the past they were selected by judges so by people who actually know something about law.

>PiS is not really my party but people who say we don't need reforms in judicary system are morons.
Nobody is saying that you strawmanning retard.
Anyway, PiS' reforms won't fix a single one of judiciary problems. The only thing that will change is that they will replace educated judges with "their" people who will be 100% faithful to reigning party. You might complain about current judges but what is coming is 100% guaranteed to be infinitely worse. There will be absolutely no justice now. It will be "only PiS is right and anybody who disagrees goes to jail".

>Most of those people don't understand and can't explain against what they protest
They are protesting against PiS who's taking over every single piece of power in the country. We're on the path for whole country to be ruled by a single person, a dictatorship. That isn't good.

Brussels are out in full force it seems

i wonder why...
>>
>>134447497
The difference is, our government pays absolutely no mind to qualifications and only chooses based on who's faithful to them.
They don't allow any discussions/debates in parliament. They mention a resolution and immediately vote for it without allowing deputies to read what they'll vote on. Every single correction proposed by opposition gets rejected for the sake of it. The votings are always instantaneous and quite often late at night. Democracy in Poland is a fiction. There's one ruling party who does whatever. When they want to do something that contradicts constitution they simply go with it and don't care if specific type of resolution requires 66% of votes. And so on, and so on.

you know nothing. In 1066 we were conquered in a sneak attack by the normans which annihilated the nobles of england. William the conqueror knew that he couldn't rule by force as he only had 12,000 men, so in his coronation oath he swore to abide by the laws of edward the confessor (the laws of alfred).
Gradually over the next 600 years his successors, being normans and unfamiliar with the english concept of all men being accountable to the law and even the poor having common law rights, gradually eroded the rights of the commoners, thinking they were Euro kings. This led to rebellions every few decades, 1215 magna carta, 1381 the peasants revolt, 1450 the kent rebellion, 1497 cornish rebellion, 1549 ketts rebellion and then 1642 the civil war.
We replaced the king with the only man who could be trusted to not imagine himself a god, who literally refused the title of king when it was offered to him. And again, you are confusing the european model of a king with the english one, where the king is not entitled to persecute his people, he is the accepted figurehead of the nation and accountable to their goodwill, exactly the same situation which exists today.
There is nothing subservient about having a king, it is a national figurehead that everyone can feel proud of, who embodies the spirit and honour of the nation. This permanence acts as a check on the passions and fashions of the day, and prevents men taking power and then using it to entrench themselves.
Exactly the problem that you have in america, where without any superior office your "representatives" imagine themselves king of the world and offer no deference to anyone or anything, only their own material gain.
And we imported the royal family from abroad because our royal family (the normans) at the time could not be trusted to not erode the rights of the people, and William of orange was sworn to do this at his coronation. His successors have kept their oath.

Nice arguments, PiS shill. Everything I said is true.
>>
>>134461554
Well, it's ruled by one person effectively. But it will never be anywhere near as bad as in those countries. Kaczyński does want that extent of power though and he's doing everything to achieve it. 80% of shit PiS does is solely for securing power and it's stuff that was never mentioned during elections. The 20% is indeed fulfilling promises from elections time but at the very high cost (they introduced something way more retarded than obama care and now our budget is fucked, prices of everything are rising rapidly too).

Then what is your endgame? Obviously, we can whine that many things could be done better, I would personally prefer, if people elected judges, based on their achievements and experience, BUT you have to start somewhere

Consider the following: if anything that the current government is doing is causing such a ruckus from the other side, then maybe, just maybe, they are doing a good job. I don't trust anything that opposition says.

Your arguments are so fucking naive and simpleminded, that I don't even know where to begin. PO did whatever they could, without any regard to the law, nothing was stopping them. If PIS wanted to be like PO, they could do the same, but they aren't. Only a fool would equate opposition with the ruling party.

>Your arguments are so fucking naive and simpleminded
Which ones? And opposed to what? If anyone is naive and simpleminded it's people who believe PiS will save judiciary system by choosing their own supporters. Get real. It's been proven many times that PiS pays no attention to qualifications of people. Every party tends to choose their own people but previously they at least chose guys who were qualified for their jobs. In Kaczystan the only thing that matters is if you're obedient. Other parties were bad but PiS is the worst thing since PRL.

And re-read what I wrote: PO did whatever they wanted. They wanted to break and enter into a house of some troll, they did. Tusk was literally the first person to sign ACTA/SOPA. Now then, there were the biggest protest in Poland, because every city had over millions of youth protesting against it. Did you forget about it?

Or maybe, how every national company, including strategically important ones were being slowly bankrupted and sold off to foreign companies? Get real, PO did whatever they wanted, without giving a shit what people were thinking.

>>
>>134475493
Let's not forget that we don't know what these corrections were. Nobody ever said a simple example of what such "correction" was.

When PO was in power, they kept saying to PIS "when you win the elections, you will be allowed to do whatever you want" in a mocking way.
Now that they did, they are angry.
>>
>>134449654

>>
>>134475698
Now, imagine that in your country, the judges are elected among people who are loyal/obedient to enemy government who were trained by them, and who are basically against you, or american values, and who instead of being taken care of, had free reign to decide who goes to prison, and who goes free. Now you will have a picture of what is at the stake here.
>>
>>134474996
Nice generalities.

>>134475131
No, I described current government. I can see however that you're quite skilled at changing the subject. It's all what PiS supporters do - never respond to anything that is inconvenient to them and constantly pull strawmen. "someone else was bad so we can do whatever we want and you have no right to complain or else it means you were supporting them". I stated multiple times I didn't like what PO did. It's totally irrelevant to what PiS is doing anyway. We're talking about PiS now.

>You are acting, like some great harm is going on.
because there is.

>You also forget that PIS has inside fractions that mistrust each other, but it's another topic for another time.
For someone who "cares about results" you sure don't care about the fact they always vote exactly like Kaczyński orders them to, even if they have no idea what they were voting on because resolution was published fifteen minutes before the vote. It was clear few days ago. Everything by opposition gets rejected in all votes but when Kaczyński raised a hand all those people voted for.

>The fact that you use the term (...) tells me everything I need to know about you.
Yeah. Because you have no intention of taking part in actual discussion and try to shame me because you didn't like one word. You're spewing logical fallacies like a machine gun.
I have no idea who invented the term and don't care about it. I used it because it's accurate.

Actually, I am angry that they are very lenient.

What harm? Like, you are going to buy bread, and then Kaczyński attacks with "gorszy sort, bitch"?

>For someone who "cares about results" you sure don't care about the fact they always vote exactly like Kaczyński orders them to,
Good, politicians are human waste, at least they are useful. You don't actually think that politicians have any opinions of their own? Because again, that's super naive.

>And they would run away again.

I'm not surprised that there wasn't a single sensible argument from them. Because you know, if opposition had brain, they could have used it as an opportunity to showcase their program, except they have none, other than "fuck pis, because they're evil"

>>
>>134476565
If you think all judges being obedient to one person isn't bad, I don't know what else to tell you. Just because Kaczyński won't personally hit you doesn't mean there's no harm.

>at least they are useful
Except they aren't.

>You don't actually think that politicians have any opinions of their own?
Of course. And anyway, they can't even form their opinions if PiS doesn't allow them to actually read the resolutions, think and discuss them through.

>Yeah, and go back again, until at some point got pissed off and go full allah ackbar. Get real, kid.
Okay, so you will continue this back and forth until the end of time because you need to have the last word. The thing is, what does it matter? Go back to the beginning of the discussion. What you're saying right now is irrelevant.

They were saying what exactly they want to change in specific resolutions. Like "I don't agree with article x and I propose to change it in this way". I don't watch TV much but saw it dozens of times.
Oh, and I assume the corrections were numerous because PiS never allowed any debate so opposition had no time to turn them into one big correction. The "delay tactics" were only put into place after what PiS did with constitutional tribunal or whatever it's called in English. Because PiS was breaking every law imaginable and there was imply no other way to stop them without outright using physical force. It's a reaction to illegal ruling by PiS.
>>
IT'S UNCLEAR WHO IS RIGHT HERE

The problem with our Judiciary is that they have written for themselves constitutional laws that make them independent AND TOTALLY CRIMINALLY UNTOUCHABLE AND IN CONTROL OF ENTRY TO THE JUDGE SYSTEM.

There are no checks and balances over them.
>>
>>134477081
>I don't think that the judges will become suddenly pro-pis, just sayin'.
They won't. However if Ziobro doesn't like the verdict he can simply tell that judge to fuck off and move the case to other judge and so on until he gets the verdict he want. He doesn't have to argument it in any way. He decides which verdicts pass and which don't.
>>
>>134477999
Of course PiS is in the right, and its only better they modified the ruling to a 3/5 majority vote
>>
>>134477999

>>
>>134477579
>If you think all judges being obedient
You are naive if you think that they will be instantly going to be obedient. I will repeat, it's only the beginning of the battle, and we might learn much more interesting things later this year, because I am certain that we only know like 0,1% of przewały that they were doing.

>Except they aren't.
Except they are, and we can go back and forth.

>And anyway, they can't even form their opinions if PiS doesn't allow them to actually read the resolutions, think and discuss them through.
Newsflash, the same goes to every other party, maybe except of Kukiz, but apparently, they have personal problems, and it's possible that this party will dissolve. Liroy already left.

>What you're saying right now is irrelevant.
And what you are saying is downright naive and stupid. Germany will just not allow for registered rapefugees to leave Poland. The thing is, we don't need them, and we have no moral obligation to take them. End of story.

>Oh, and I assume the corrections were numerous because PiS never allowed any debate so opposition had no time to turn them into one big correction.
I'd rather trust the other anon who says that they were trying to obstruct the reform, just like they tried to obstruct the budget last year. Sorry, but your opinion is not trustworthy for me.

I will later google, because going through news site is like touching a toxic cesspool. Sadly, there are no objective news.

>Because PiS was breaking every law imaginable
Are you a lawyer? Because that's a bold statement. Pis, for all the things they do, better or worse, are actually very literate in law. They know what they can do, and what they cannot do. If anything, that should show you the quality of the law in Poland.
