Without reading your post or clicking that gay link, the issue doesn't hinge on free speech but invasion of privacy. In the US I'm not certain this is a crime per se (it's possible), but whoever recorded or posted the video could be civilly liable without doubt

He would have requested that the video be taken down, also he was not informed the video would be uploaded. Therefore no consent or refusal was given, he apparently had no knowledge of it being uploaded. Therefore he did not consent. It really depends on where it was filmed.
If they did it in the open on the streets or at a park then it would be legal to post.
However, if it was filmed somewhere where there is "a reasonable expectation of privacy" then it is illegal to even record them without their permission.

note that in front of an open window is public domain and anyone is allowed to stand on public property (sidewalks) or their own property (neighbors) and record video of stuff inside your house.

If someone tries to pretend that they didn't really know, the evidence would be against them.
