Yes, once due process is followed. What civil forfeiture is is a way around that. Instead of gathering evidence against you and taking it to a judge, your property is charged with a crime. You need to hire a lawyer and defend your property in court to get it back. It's totally fucked. If you have too much cash when you get pulled over they can seize it and if you don't fight it they take ownership.
