it is 100% legal to shout Fire in a crowded theater, and has been since the current standard for the legality of speech was established through precedent in Brandenburg v. Ohio.

The Government cannot prescribe Speech, not even speech that is directly intended to "proscribe advocacy of the use of force or of law violation", except where said speech includes "such advocacy is directed to inciting or producing imminent lawless action and is likely to incite or produce such action.", which is legally classified as a "True threat", in legal terms.

Yelling Fire in a Crowded theater does not, at all, meet that legal standard. Neither does recommending that Trump be "Executed if found guilty of treason in a court of law", or any of the leftist heated political rhetoric from the media. (The same way that telling someone "Kill yourself" or "I hope someone caps you" or "I hope you get cancer and die an agonizing death" is not in any way a death threat).

In short, it is absolutely legal to, for example, write an article discussing the merits of, or even recommending, that people do not pay their taxes, riot on the streets, or even recommending that "we" should "take out Trump".
