How would the cop know? Is he clairvoyant? All he knew at the time was that this man said he was armed and started reaching in an area that could have a weapon. If cop backs off and suspect pulls a gun, cop has no cover and is fucked. In this case, the cop was wrong, but there was no real way to safely deescalate and preserve officer safety.

1.Driving while Intoxicated
2. Illegally carrying a firearm (because permit obtained illegally and because intoxicated)
3. Failing to comply with instructions after telling the cop he had a gun (probably because intoxicated)

Castile had to commit several crimes to end up in that unfortunate situation, where as he disregarded the officer's instructions, the officer had to make the call.
