still, you shouldn't get to retry someone until you get your favored outcome. if they declared a material for a reason other than the hung jury I would understand the retrial.

thats how it works. you cant just let it go because there was no outcome, in law there HAS to be an outcome, be it guilty or not guilty. if the jury is deadlocked, the trial is scrapped and you start over until you get a result.
it's not about the "favored" outcome, it's about getting any outcome at all.
