Read the link I posted. That's what makes them public domain. If he wrote them at home on his own time (and not as part of his duties as an employee of the FBI) they would be his private property and he would automatically hold copyright over them. Since he wrote them during work hours on FBI computers, they legally belong to everyone (or no one). Government works are specifically excluded from copyright.

Anyone who is aware of their contents is legally free to share them, copy them, reproduce them, etc. However any employee of the FBI could be ordered not to do so, and the president could effectively gag their contents by exerting privilege.
