FDR signed EO9066 that locked up the Japanese, Italians and Germans. This was during wartime, and technically the USA is still at war - notice how Trump has ramped up displays of US might. This was to establish acts that constitute acts of war, so he can argue that both the war in Afghanistan and the war in Iraq are ongoing. This means he's under the same legal power as FDR to sign anti-immigration EO's.

There are many other EO's that relate to immigration as well, suggesting that a president can do whatever he wants via EO. Trump is trying to push it to the supreme court so there can be no dispute.

He might make the bans indefinite after he get's the ruling he wants.
