So: that isn't how it works in the UK. Her Majesty's Government is, in reality, whomever can "command the respect of Parliament" I.e. whichever group thinks it can actually get shit done.

In the simple cases that's just whoever has the majority; at least 50% +1 seat. In less simple cases of a hung parliament, it could be *any* group. The rules say that the incumbent normally gets first try at forming a Government, so that's what the Conservatives are doing. But, if they can't reach a deal with the DUP, and Theresa decides that she can't govern with a minority government, then it would be expected for somebody else to have a go. In this case, that would be Labour.

Would it be sensible or realistic? Almost certainly not. Most minority Governments don't last more than 12 months: Labour would be far better off just waiting and watching the Conservative/DUP chaos machine collapse, and then force a parliamentary vote on another General Election.

She is currently attempting to form one. The Chief Whip has flown out to Belfast to start talks with the DUP (which was silly, because the DUP won't do anything except go to church tomorrow...). It'll be days before they reach agreement and longer still before the Bill is published.

So it's hard to imagine, because it has never happened in the modern history of the UK, but imagine: the Queen objects to Theresa entering into a pact with the DUP, which directly endangers an agreement with Sinn Fein for Stormont, and a return to direct rule which endangers peace in NI. OR Tory rebels vote against their own Queen's Speech Bill because they are uneasy at a deal with the DUP OR the HoL vote against the QSB because fuck everything.

At that point the Conservatives will have "lost the confidence of Parliament" and Labour would very likely be invited to attempt to form a Government. Now, if he was smart, his answer is "Your Majesty, I am afraid I can not command a majority" and decline to form a Government (which is true). At that point the ONLY choice is another GE.

Thinking about it, there'd ALSO have to be a Conservative leadership contest before that could happen. So you'd have, what, two or three months without a government? While the AR50 clock was ticking?
