The ban can be everything it wants to be. But he keeps saying that all he wants is keeping muslims out. that is the problem.

If he had never said the "ban all muslims from entering the us..." thing and subsequent stuff the ban would have passed without problem because there are grounds that those countries pose a danger.

When the next muzzie allahu ackbars himself and 30 others in America (and it will happen) guess which party owns the attack, The Dems who blocked his travel ban.

Trump doesn't even want it to pass at this point, it only prevents 3% of all muslims coming to the U.S. but by making everyone think he wants it still when the next attack happens, every America will think, "Well Trump wanted to protect us, this is what we get."

Syria strike was 4D it's been explained a million fucking times already on this board, retard. Don't tell me you actually fell for MAT/Shareblue that was on standby mode for it to happen.

Remember Clinton has Obama moles and holdovers as well as NeoCons like McMaster who leak her information. That tweet of hers moments before it happened was no coincidence. If she knew, Shareblue knew.

The end result is the same the only thing that we can disagree on is whether it was deliberate or not. Assad, Putin, and Trump came out on top and Israel/the rebels got hurt in the long run.

>Stop perpetuating doubt that it's "unconstitutional." It's perfectly within the presidential powers granted by the constitution, and what more, has historical precedence because IT'S BEEN DONE BEFORE AND NO ONE GAVE A SHIT.

Everyone knows that. But Trump said mean things about Muslims (intent is was has caused this mess) and half the SC are Jews and cucks. More than likely, he thinks that the SC will rule against it, so he just doesn't give a shit. Like I said before, he should just do it anyway. There is no proper checks and balances for activist judges who make constitutionally invalid rulings, especially those on the SC.

Who do you work for Media matters?

Start realizing DJT is 10 steps ahead. In a few years muslim hatred will be so widespread that he will be known as a visionary.

Winning scenarios:
>bill not passed muslim from shitghanistan blows something up, blame pinned on Dems
>muslim ban passes, nothing happens, DJTs vigorous efforts kept us safe!
>ban passes, muslim still blows something up, tougher ban needed, cant claim he wasn't tough on muslims

Only losing scenario here is the least likely.
>ban doesnt pass, no muslim blows anything up. Still kind of a win DJT can claim it was his other policies on muslims that kept us safe.

This.

The Constitution does not say anything about immigration (only naturalization).
The Constitution only applies to citizens and (in a LIMITED capacity) foreign nationals who are WITHIN U.S. territory.
Over a hundred years of case law has affirmed Congress' right to regulate immigration as it sees fit.

We also do not extend any constitutional rights to non-citizens who are outside of U.S. territory. Doing so would be completely unprecedented and literally retarded. The people claiming there is some sort of 1st amendment protection for certain religious foreigners are so stupid it hurts.

A travel ban preventing non-citzien muslims from entering the U.S. would be 100 % constitutional. The EO isn't even anywhere near that in scope, it's positively tame in comparison. Can't wait for the libshits to get blown the fuck out in a 9-0 decision.

Nope. Animus, or illegitimate prejudice towards a group is not a legitimate pursuit of government. An immigration law rooted in animus towards a group (ie muslims) is therefore not a legitimate pursuit of government, and any laws giving the president latitude in immigration decisions are irrelevant. This is the key argument against the travel ban, and one likely to succeed due to Trump's many statements about wanting a ban on muslims entering the country.

Per your hypothetical, a ban on all non-citizen muslims entering the US would illegitimate due to overt animus.

>Omar C. Jadwat, an ACLU senior staff attorney, argued that the revised ban should be deemed unconstitutional because of Trump's anti-Muslim comments while on the campaign trail and after the election.

>"We have an order on its face," Judge Paul Niemeyer said, pressing Jadwat about the hypothetical scenario. "We can read this order and we have no antecedent statements by a candidate about this order. We have a candidate who won the presidency, some candidate, president, other than President Trump won the presidency and then chose to issue this particular order with whatever counsel he took. … He issued this executive order. Do I understand that just in that circumstance the executive order should be honored?"

>"Yes, your honor, I think in that case it could be constitutional," Jadwat answered.

>Jadwat then avoided questions from the judges about whether the text of the order itself was unconstitutional. Jadwat said there may be nothing Trump could say now to make his campaign statements about banning Muslims from the U.S. not matter in cases concerning the travel ban.

>Pressed by Judge Dennis Shedd, about whether any repudiation of the campaign and post-election comments about a Muslim ban would satisfy Jadwat, the ACLU indicated there's not much Trump could say now.

>"I think a simple repudiation might not, no, would not change the result," Jadwat told Shedd.

>"Let me follow up then, what if he says he's sorry every day for a year?" Shedd said to laughter in the courtroom. "Would that do it for you?"

>"No, your honor," Jadwat answered.

>>
>>128682017
Show me a case where animus is territorially bounded.

Furthermore if the travel ban is found to display animus towards muslim foreign nationals, the animus would obviously extend towards muslims within the US.

The argument is that when the president makes dozens of statements condemning and disparaging Islam as a whole, promises to ban all muslims from the US, enacts an EO explicitly based in animus-laden campaign promises, and continues to describe muslims as a whole as a problem for the country, the notion that a line can be drawn between animus towards foreign and domestic muslims becomes untenable.

Imagine if Obama talked about restricting immigration of white people into America, then enacted an EO banning immigration from European countries. White people would be shrieking about being targeted by the government. Especially if the Obama had made dozens of statements condemning white people without any reference to national origin, but instead with reference to the supposed essential nature of white people.

>>128683248
This is a silly argument. The EO follows directly from Trump's long and targeted crusade against the muslim community. The context of Trump's conduct makes this clear. People try to get around this by insisting people only read the text of the order itself, saying that by the text of the EO alone, it is constitutional.

Thing is, a legal rule promulgated with unconstitutional motives can be invalid even if the same rule promulgated for legitimate reasons would be valid. If a legal rule is enacted for a combination of legitimate and illegitimate motives, the validity of the rule depends on whether the illegitimate motive was a but-for cause of the rule’s enactment—that is, on whether the rule would have been enacted had the illegitimate motive not been present.

>>128683262
White people have a higher probability of committing mass shootings in America. Should they be banned from acquiring firearms because of this?

And if you look at the history of terror attacks on US soil committed by muslims, you find the perpetrators are people who had been living in the US for years, sometimes decades, who were radicalized while living in the US. Meaning the travel ban would have done nothing to stop them.

There is zero evidence that current vetting procedures are inadequate. There is zero evidence of terror attacks that would have been stopped by a travel ban. There is zero evidence of some existing flaw in our systems that would be remedied by the EO. The argument that the EO is necessary for national security has no evidence behind it.

That's not how precedent works. All previous cases dealt with citizens who were subject to the constitution. You need to demonstrate that non-citizens outside of U.S. territory are potentially subject to animus. Spoiler: they're not, that's retarded.

The rest of your argument boils down to: "if the court legislates from the bench and applies animus to foreigners, suddenly giving them all constitutional rights, then the EO would be unconstitutional". No shit, nice fan fiction.

By your own logic if animus against a religion impacts an EO, then should amity towards a religion also impact an EO?

https://www.gpo.gov/fdsys/pkg/FR-2016-10-11/pdf/2016-24736.pdf

In regards to refugees, you can see that the near east had the biggest allocation. Furthermore, should not Obama be implicated for his comments about Islam as well?
>>
>>128684986
>White people have a higher probability of committing mass shootings in America. Should they be banned from acquiring firearms because of this?

This is not an argument against a ban. Furthermore, Islam is a religion not a race, so clearly you're anti-white if you jump to such an argument. Perhaps that is why Obama restricted the number of refugees from Europe.

>>128685324
Remember. the first amendment states

>Congress shall make no law respecting an establishment of religion
You argue personal animus towards a religion can make an EO that impacts that religion unconstitutional, by that logic amity towards a religion can make an EO that impacts that religion unconstitutional as well.

If that is the case, then Obama prioritizing the middle east for refugees is a direct example of his amity towards Islam and thus those refugees are here illegally.
>>
>>128685002
>Reading comprehension

Ignoring that you're being the guy who can only ask for evidence but can't provide any, I'll remind you that the animus doctrine is under the Establishment Clause. This forbids the government from acting on the basis of an illegitimate purpose, such as bias or prejudice toward any particular religion. Any animus shown towards foreign muslims would extend to muslims in the US. Your convolutions about animus towards non-citizens somehow amounting to giving them constitutional rights is nonsense.

If such an EO came from a long context of overt amity towards a religion, there may be an argument. But in that case, the argument would be made that amity towards that religion leads to animus towards others.

In the case of the travel ban, what is important is is the context behind the EO. Going back to the but-for cause of the motive behind the EO.
>>
For instance, in this video Obama claims ISIS is not islamic.

https://www.youtube.com/watch?v=pwp8qKvE-0g

However, does he have the constitutional basis to make such a distinction?
>Congress shall make no law respecting an establishment of religion

Does this not affect every executive order Obama makes, due to him making a religious interpretation of ISIL's justifications? By claiming ISIL is not Islamic, the president establishes himself as an arbiter on whether a group is islamic or not. In that sense, he is declaring ISIL a bunch of heretics claiming to be Islamic. Using this logic, wouldn't any executive order he signs to deal with ISIL actually be him unconstitutionally acting on animus against a heretical form of Islam?
>>
>>128685856
>Focusing in on an analogy and ignoring everything else

Typical. Firstly muslims do not have a higher probability of committing terrorist acts. 94% of terror attacks in the US since 1980 have been committed by non-muslims.

Now I'll ask again. What evidence is there that current vetting procedures are inadequate? What examples are there of terror attacks on US soil that would have been stopped by a travel ban? What evidence is there of flaws in our current system that would be fixed by the EO? What evidence is there of a flaw in our national security systems that require the EO to fix?

You fail to incorporate a per capita mindset. To claim that 94% of terrorist attacks were not Islamic, does not imply that Muslims are less likely to be terrorists. 99% of Americans are not Muslim. In fact, isn't it odd that 1% of the population commits 6% of the terrorist attacks?

>What evidence is there that current vetting procedures are inadequate?
>What examples are there of terror attacks on US soil that would have been stopped by a travel ban?
>What evidence is there of flaws in our current system that would be fixed by the EO?
>What evidence is there of a flaw in our national security systems that require the EO to fix?
All of these questions are irrelevant to the question of constitutionality.

Considering all terrorist attacks of note, you will notice that jihadist terror attacks have a higher kill count. Furthermore, you have yet to consider demographics into your calculations. It would be no surprise that the largest ethnic group would have the highest raw count, but if a very small group has a slightly lower kill count it is nonsensical to claim an individual in the largest group has the highest probability of committing a terrorist attack.

Only 1% of Americans are Muslim, yet they have such a high kill count through terrorist attacks. Clearly Muslims have a much higher probability than any other religion for committing terrorist attacks. How exactly is banning a group that has such a high probability irrational or illegitimate?

Even including right-wing terror, jihadists have a much higher kill count. Furthermore, Muslims are a minority in Europe. This means compared to all other religions they have a much higher probability of committing a terrorist attack.

You're still jumping a gap here wherein the establishment clause and congress' immigration powers intersect. It's not obvious at all that a religious test for non-citizens would violate the establishment clause. Blackman gives a better rundown of why the establishment clause argument is not going to work than I can. It simply has not been applied to immigration in full force, and I believe the crux of the issue is the point I've been making: whether or not it even applies, not whether or not it's a violation.

>>
>>128689339
Because there's nothing predictive about it. Generalizing the statement, going after any ethnic or religious group because "this group has a higher probability of doing X" isn't a valid strategy. Also every recent terrorist attack committed by a muslim has been either a second generation muslim or an immigrant living in the US for multiple years. A travel ban would not have stopped any of them. The travel ban is unconstitutional for the reasons I have already listed in this thread. Nothing in your post changes that.

Was this executive order unconstitutional

(1) For purposes of subsection (a), the Attorney General, in consultation with the Secretary of State and the Coordinator for Refugee Affairs, shall establish--

(A) one or more categories of aliens who are or were nationals and residents of the Soviet Union and who share common characteristics that identify them as targets of persecution in the Soviet Union on account of race, religion, nationality, membership in a particular social group, or political opinion, and

(B) one or more categories of aliens who are or were nationals and residents of Vietnam, Laos, or Cambodia and who share common characteristics that identify them as targets of persecution in such respective foreign state on such an account.

(2)(A) Aliens who are (or were) nationals and residents of the Soviet Union and who are Jews or Evangelical Christians shall be deemed a category of alien established under paragraph (1)(A).

The strength of the Establishment Clause argument lies in that it is structural. The value of a structural constitutional limit in the current context is that it permits a person currently lawfully in the United States to object to what the government is doing even though what it is doing occurs overseas (at US embassies and consulates where applicants are denied visas) or at ports of entry. Unlike arguments rooted in Free Exercise or Equal Protection, the structural nature of the Establishment Clause avoids the issue of applying constitutional rights to non-citizens. It simply requires a showing that the plaintiff (who is a citizen) is injured by the government's violation of the Establishment Clause.

So, imagine a judge or justice who thinks: 1) rights provisions don't apply to aliens outside the US; but 2) the Establishment Clause does apply to actions taken outside the United States because it's structural; and 3) subjective evidence of bad faith (animus) in adopting the travel ban shows an Establishment Clause violation. That would be the end of it.

Ah, so have you seen the latest data?

https://www.europol.europa.eu/activities-services/main-reports/european-union-terrorism-situation-and-trend-report-te-sat-2016

In particular look at the arrest data, 198 arrest for Jihadist terrorism and 94% guilty verdicts for those arrests. So out of all the total 417 convicts for terrorism, 186 were jihadists. This means out of all the terrorism convictions 44.6% were jihadists. Isn't that quite odd? Muslims are a minority in Europe, yet in terrorism convictions they are at 44.6%. Furthermore these stats don't account for recent high kill count attacks either.

Your argument can be expanded into any immigration preference both allowing and denying immigration. By your logic Obama unconstitutionally allowed refugees into America due to his amity towards Islam. Obama through his support of Islamic refugees in fact established a governmental preference towards Islam. I could argue that taking any refugee is by definition establishment of religion because you will never an equal distribution of religions.

If you're going to lift arguments from a blog, at least include the source (pic related 1):
http://www.dorfonlaw.org/2017/03/why-establishment-clause-has-emerged-as.html

The point about the issue of whether or not the establishment clause applies still stands, see previous Blackman and the ACRU's amicus curiae (pic related 2):
http://www.theacru.org/wordpress/wp-content/uploads/2017/04/17-1351-Amicus-Brief-American-Civil-Rights-Union.pdf

Obviously neither of us are going to get to the bottom of this, but I'd bet your feminine penis that the court rejects invoking the establishment clause.

>The travel ban is unconstitutional for the reasons I have already listed in this thread. Nothing in your post changes that.
You arguments are based on animus towards Islam being illegitimate, and I have proven many times that it is neither illegitimate nor irrational. Islam is not a race no matter how many times you claim it is. Religion is an ideology, if a religious group had a 100% chance of committing a terrorist attack, should they be discriminated against and not allowed to immigrate to America? I have stated before, Muslims tend to have Muslim children. To say a travel ban would not stop them from having children is clearly illogical, they cannot have children here if they never come here.

Your whole argument here commie is based on the idea you can use his campaign rhetoric to import motive as determined by highly biased jurists. Let's look at the overturn ratio of the 9th circuit, and dream some more. Per the letter of the law, he is within the realm of control of all immigration issues.

This includes rules pre-visa and post-visa. Your fake news has convinced you of stupid shit because you're ignorant. Visas can not be turned down after application for any reason that's discriminatory, but you can specifically as POTUS choose to not accept visa applications from certain countries for "discriminatory" reasons. This is why zero legal opinions written by jurists overseeing the case are touching writing about the law involved -- they instead choose feelings. These jurists will be crushed and the court eventually reshaped again.

The real question is, will RGB do the right thing and recuse herself for showing bias against a named party coming before her, or will she destroy her legacy and become known as the senile lady who was purely politics. I hope the latter. The reason you will lose is you think the POTUS has no plan, and isn't engaging counter moves. You aren't thinking about his game, therefore it seems like 4d chess.

Screencap this: SCOTUS agrees with POTUS, original EO legal, and current one upheld.

True, but they said they were going to use it for evaluation. I can still hope that they will decide on harsher immigration that takes even longer. Many liberals and leftists are suffering from tunnel vision and forget that the SC needs to consider the ramifications of establishing a precedent. The lower courts know they can pass the buck to a higher court, so they don't have to worry about their decisions having major ramifications for the most part. The SC on the other hand needs to consider just how much their decision will impact American government. For this reason they will ensure the status quo and affirm that Trump has the right to restrict any class of aliens.

Otherwise, the opposite scenario develops, all migrants that came under any prior president could have possibly came here out of fraud. Remember if a personal religious preference is considered an unconstitutional influence on an EO, then that means anyone who came to America under such a preference arrived here under fraudulent circumstances and could even see their citizenship revoked.
