While it is true that illegals do have some rights afforded to them by the constitution (ex. due process, right to a lawyer if they're in criminal proceedings, etc) when ICE is involved that's a different story.

By coming to the USA without inspection, staying in the USA after whatever lawful basis is expired, and/or committing a crime that warrants removal places them into removal proceedings. It's important to note that removal proceedings =/= criminal proceedings. For one thing the burden of proof that the government has to show that you violated the Immigrant Nationality Act (INA) is lower than "Beyond a Reasonable Doubt" furthermore ICE does not need probable cause to conduct a search for you or to stop and question you. You're also not entitled to free legal counsel. In fact 99% of the time the charge of removablity is sustained at their first immigration hearing and from that point on it's a matter of determining if they've got a lawful basis to remain in the United States.

ICE has a lot more leeway than the cops do. For example if you're arrested for a certain crime (let's say Domestic Violence because that's something you see quite a bit with central american immigrants), and you are given bail for whatever amount, you can and probably will still be detained by ICE, even though you haven't been convicted of anything. Also if ICE is looking for one guy in an apartment building then you can bet that they're going to talk to EVERYONE in the building that may be here illegally. ICE can stop you (aka a seizure under the 4th amendment) and can interrogate you (5th amendment) without having to read you any of your rights.

There have been challenges to these rules but so far none of them have won. In the mean time if you're here illegally the constitution is not going to save you from ICE.

For one thing their cases are put on a fast track since everyday they're locked up costs the taxpayers money. So that makes it harder to prove their asylum claims or whatever they're applying for.

But I guess if you only do bond hearings for illegals (basically arguments to the immigration court to let them post some money to let them out) then you can get more business but even those can be painful.

Not upset but there's shit that makes representing them harder. For example, most of the time when you get hired it's by the person's family and they can be unreliable.

You also have less time to get documents that could support their claim. For example if they came to the USA because a family member was killed by gang members I'd usually want to submit a death certificate to the court to help support their asylum case. If you get a judge who doesn't give you enough time then you're stuck with testimony of your client, and that can go sideways as most of them have a 6th grade education and will say anything if they feel like their backs are up against the wall.

Not only that but even if they get ordered removed that doesn't mean that they're going to be out the next day, given the fact that their cases can still be appealed. Granted if their detained and the judge denied them a bond it might not be worth an appeal since they'll still be locked up during that time.

I guess you could say it makes my job more frustrating than I'd like it to be.
