Instead they went the safe route and are going to try to strike him out. While it's clear from the Fuhrman decision that "multiple" strikes may accumulate from a single proceeding, that decision actually dealt with a subsequent conviction, with the trial court evaluating the prior conviction as the first two strikes. The California Supreme Court held that the issue was one of fairly straightforward statutory interpretation, and that there was no language in the statute holding that one criminal proceeding, or one criminal transaction/occurrence could only result in a single strike. As a penal statutory enactment, it is construed strictly.

Cal. Penal Code § 667 provides the three-strikes rule, along with other sentence enhancements. The three-strikes rule itself distinguishes between a "prior conviction" and a "current offense". The statutory structure is such that a "prior conviction" may result in a strike, and multiple prior convictions taking place in the same proceeding may create multiple strikes (see Fuhrman). But the three-strikes rule only kicks in when assessing whether to enhance the sentence for a "current offense". Fuhrman doesn't address this, nor does any other three-strikes jurisprudence that I'm aware of. And frankly, the statutory language appears crystal clear on this point. Cf. People v. Sloan, 126 Cal. App. 4th 1148, (2005), rev'd on other grounds, 42 Cal. 4th 110 (2007). See also People v. Hazelton, 14 Cal. 4th 101, 104 (1996) ("In general, the legislation provides longer sentences for certain prior serious or violent felonies popularly denoted 'strikes.' A 'two strike' case involves one prior qualifying felony; a 'three strike' case involves two or more prior qualifying felonies.").

So, while it's pretty likely this guy will get sentencing enhancements, and it's also possible that he'll have three or more strikes stemming from his conviction here, it won't be until his next conviction for a three-strikes enhancement to be applied.
