Also, yes he will go to actual prison, not just county jail. Our jails in CA are full of drug users mostly because of some new propositions that make almost all "non-violent" crime sentences served (one year or less) in county, rather than prison.

This is why sometimes you'll see judges sentence people to one year and one day in CA, because that one extra day pushes them over that limit and sends them to prison rather than county.
