if you go by ettr this is correctly exposed, but incorrectly processed

but instead of switching spot metering just consider your subject, if it is dark then just add +0.7 to +1 exposure compensation.

I think with the right editing it could work, yeah its underexposed but maybe you could use that to your advantage, make the tree branches more scary i guess and just make the hawk a little lighter with more contrast and less saturation
