We've all been there. I ditched my mothers old Saab the first winter I had my license. I could've easily blamed the 10 year old studless shit tires, but in the end it was me who was to blame. You mentioned that you knew they were chinese tires. You then said you drove normally. That was your first careless mistake. The 2nd was that the road has gravel on it.

You still have a responsibility to know how far you can push the car. Just because it's chinese tires, doesn't mean you aren't responsible. It just means the chinese ripped you off because their tires don't meet the printed claims.

If it's chinese, then they've economized it. If they have corrupt employees, the normally good quality items may have bad batches where ingredients might be diverted and substituted with low quality ingredients. The corrupt employees then pocket the difference without the company knowing.

That's why the driver has "test drives" on safe level roads to discover if the tires live up to the published claims. That might even be test driving on a large empty parking lot by driving fast around some marked aisles. If a spin out or oversteer slide occurs, there's no harm since the car remains inside the lot.

There are lots other ways to test the limits of chinese tires without wrecking the car into a ditch or obstacle.

I think the car drove into the side of a hill slope before it hit the tree. The hill was kinda loose dirt, helped slow the car down. Other then that we must have hit the tree in the perfect spot.

also the nurses were saying if your asleep/drunk/ unaware the accident is coming and you dont react to it you dont get as badly injured cause your muscles arnt tensed up for the impact your just loosy goosy
