Let me start off by setting the stage:

>You have back pain, seat belt broke ribs, and airbag annihilated your glasses
>Lacerations on forearms and hands
>Broken fingers, a tooth is missing
>Solid 5 days at the hospital with all the scans and tests
>3 months out of job
>dental and optical bills

So the insurance on the other guy gives you a settlement which will cover all of your medical bills, lost wages, lost property, and pain & suffering. At what point do you lawyer up? I ask because my family was involved in a similar accident when I was young (Mom, Dad, and I) I never understood completely why we went with a lawyer and why my mom later regretted it a few years later.

Yes. Lawyer as soon as possible. When I got hit by a car, I fucked up and settled because I didn't think I was hurt that bad. Now coming up on a year later, my back is still fucked and the $5600 I ended up getting out of it will never cover the days I will have to take off work in the future because my back is fucked up.

Also, just because you get a lawyer doesn't mean a long process with court dates. They will probably still settle, but give you something better.

Lawyers aren't saints, they do not have your best interests in mind, and they want to bill you as many hours as possible. Keep this in mind whenever your lawyer nugdes you in the direction of litigation.

My dad was riding his bicycle when someone hit him. He got really lucky and was really just bruised up, a some painkillers and a few trips to the chiropractor fixed him up. He did take a few weeks off work, as well. His $5k carbon fiber bike was basically totalled, tho.
He got a lawyer, and after the lawyer took his fees and the doctor bills paid, dad got about $15k in cash. Enough to buy himself another bike and then some. So I guess in that case it was a good thing he got a lawyer.

My case was funny because I never lawyered up or anything and was just willing to walk away. Got workers comp to cover my lost pay for a couple months on light duty. Never expected any money out of it.

Then like 2 or 3 months after I had gone back to work, so 4 or 5 months after the accident, some lady from the insurance company called me up talking about a settlement.

Just call a couple lawyers and see what's up. They aren't going to charge you anything right away. They will take their cut when all is said and done. Just don't sign any settlement offers until you are sure that is what you want.

Whenever you can get the fuck on with your life, honestly. If you're back on your feet and in the black, is it worth fighting the guy...'s insurance company? What are they gonna learn? You can always book a consultation with a specialist lawyear and see if there's a solid chance to get a fairer deal. But if it sounds too good to be true it probably is.
