Drunk drivers are liable for felonies for people they injure or kill, even though they have no malice. Drunk or not, this guy was aware he was doing something wrong. That makes it much easier to decide that he's liable for a felony, even if at some point in the evening he and/or she might have thought there was some flirtation.
