He is free to "leak" whatever he wants as long as it is not classified info.
He is free to put classified information in memos if he wants, as long as he doesn't allow folks without the proper security clearances access to them.
So far, there's absolutely 0 evidence that the memos he leaked contained classified information.

You can't be prosecuted for leaking unclassified government documents. They have to be classified. Comey stated that some of the memos he wrote were classified and some were unclassified and that he only leaked an unclassified one. No one is claiming that Comey leaked something that was classified, but they're sure trying their hardest to confuse people into thinking he did.

As the head of the FBI, he has the ability to de-classify any information he wants in order for it to be leaked without prosecution. We will never know for sure if any of that information was previously classified, but the fact that a man in his position was leaking information to the press is frightening.
