Germany Officially Gives Up On Free Speech: Will Fine Internet Companies That Don't Delete 'Bad' Speech

Social media companies face fines of up to €50m (£43m) if they persistently fail to remove illegal content from their sites under a new law passed in Germany
The German parliament on Friday approved the bill aimed at cracking down on hate speech, criminal material and fake news on social networks – but critics warn it could have drastic consequences for free speech online.

The German justice minister, Heiko Maas, who was the driving force behind the bill, said: “Freedom of speech ends where the criminal law begins.” Maas said official figures showed the number of hate crimes in Germany increased by more than 300% in the last two years.

The new law also has an even weirder provision, putting liability not just on the platforms, but on individual employees at online platforms who are designated the Chief Censors for that platform:
Aside from the hefty fine for companies, the law also provides for fines of up to €5m for the person each company designates to deal with the complaints procedure if it doesn’t meet requirements.
Who the hell is going to want that job? Make one mistake in failing to censor something, and you may be bankrupted.

So if I shitpost on /pol/ all day long, can I benkrupt Hiro?
>>

Doubt it. He already gets thousands of letters from lawyers. But Hiro can't read so he throws them all in the garbage.
>>
Is that you Boris?
Congrats on the election btw.

The law doesn't apply outside of Germany. 4chan could only really be fined if it was hosted there.

Fortunately, in America, we have freedom of speech unlike Yuropoors.

What happens to the sadsack Germans posting here?
>>

Commie Merkels Gestapo kicks down your door and throws you in a Muslim filled prison where you get raped to death.

Gotta use Hooktube since the video talking about censorship was censored.

Well no shit, they weren't defined as hate crimes by law two years ago.
>>
Could this be the end for Germany posters?
>>
>>153509
That doesn't seem correct. This law is targeted at social media like Facebook and Twitter. Pretty sure those aren't hosted in Germany.
>>
>>153549
A lot of larger companies would have offices there. If not then this is just unenforceable. Because you could not apply German hate speech laws to Americans as long as those people aren't in Germany.

There is a Swedish company that did this to get away from Swedish laws on speech. I think it is called Flashback. So, the most Germany can do is fine companies that have some office/work there or German citizens. They can't do shit to an American site or American citizens. Hiro/any American isn't even required to give up anybody because their only obligation legally is to follow American law. Because 4chan also has the rules you accept. The one that says if you are under 18 or if it is illegal for you to stop browsing. So, American companies/anyone with no hosting/offices there is fine. So is everyone outside of Germany. The burden of controlling their citizens will be on them, not the whole world.

So what's stopping Facebook et al. from closing their offices or whatever in Germany? Does a web based company really need a physical presence in a bunch of random countries?
>>
The leftists on here and the rest of the neo-Marxists internet wish they could get this here.
>>
>>153486
I hope they go after 4chan tbh.

Facebook could still be sued by Germany, just like France is suing Google over to France's "right to be forgotten" law.

Even though French Google adheres to French law, the French are demanding Google censor it's entire global network to comply with French laws.

Not that this is an issue for Facebook, as already know Zuckerburg is working hand-in-hand with governments to censor posts and get users TOSsed for not following the party line....
