But I'm not sure how to go about fixing it as mavic doesn't specify any options for axles, but iv seen these wheels on this frame before! Is there a way to get replacement dropout cover set that has a m9 gap?

OP, it doesn't matter, just push down as you tighten the nuts so the axle is touching the top of the dropout.

It shouldn't be a problem. Just think, if the pressure from the bolts weren't enough to hold the axle securely horizontal dropout wouldn't be a thing in the first place. If you want you could wrap the part of the axle with electrical tape, just to help with getting it lined up right.

This is accomplished while simply putting weight on the frame and putting the bike on the ground when tightening the wheels instead of trying to do it in a stand or something.
