Because it's not a fraction or a ratio. 3/8 means three eighth notes to a bar, meaning 3 8th notes in each bar. There's very clearly 3 quarter notes in that bar, so even though the count and feel is the same, the time signature is different. 3/4 is typical used for like trios and waltzes, 3/8 for fast tempoed music. The distinction is mostly to convey feeling to the performer if anything.
