Sunset stole a crown, committed treason and almost killed Twily and had no puishment. Starlight tortured and brainwashed a town of ponies and then fucked up the timeline multiple times and also almost killed Twily. If treason, attempted murder of royalty and altering the timeline brings no punishment, I'm not sure anything will give the death penalty.

Death really isn't a viable option when they have equally bad alternatives to major crimes.
