No, the levels are definitely off. This might be a player/decoder issue for you though, rather than an encoding issue, because the other source you're comparing with also has messed up levels, but the BDMV does not.

x264 doesn't explicitly (by default) declare TV or PC levels to my knowledge, whereas BDMV streams are required to declare it, so the decoder knows how to handle the levels. Weird thing is though, most decoders can automatically detect based on resolution, and it's generally assumed that they playback to PC levels.
