Winkysoft only had permission to use designs from the show. The design they took from Nagano was the Blood Temple, which came from one of his own artbooks. Worse of all, that artbook was the prototype for the story of FSS and illustrated several important events from the official FSS timeline. Obviously Nagano didn't want L-Gaim and FSS to be mixed up, and never gave Winky any permission to use his designs. I don't know if he even said anything to them personally, but Winkysoft did offer an official apology for this later on. He never took any legal action on them. It has nothing to do with how Nagano feels about "lesser designs" or whatever bullshit you shove in his mouth just so that you can get mad at him with your personal headcanon.

As for the FSS and L-Gaim connection, Nagano himself was responsible for all the designs and a good chunk of the story. It's not at all uncommon for designers and artists to make updated versions of their older work and slap a new name on it. Like how Makoto Kobayashi put in Baund Docs and The-O into Dragon's Heaven, or how Miyazaki took the work he did on Future Boy Conan and turned it into Laputa. Not to mention that L-Gaim itself was mostly based on Star Wars, so legality is out of the question.
