It's really very simple.
She knows Gato is being a dick. He ditched her out of nowhere and now he's dropping a colony on the earth. She tries to stop him but he tells her it's too late already. She can shoot him and let it fall randomly on some civilian population center, or she can let him make the course correction and send it to his intended target.

What she CAN'T do, or rather what she is emotionally unwilling to do, is to let Kou kill her ex-boyfriend that she still has feelings for (your lover disappearing out of nowhere makes you carry a torch for them for a LONG time). Why does she stop Kou? Because she's developed feelings for Kou but if he kills Gato she'll never be able to look at him without thinking about it so she'll be back to being alone. She's not trying to help Gato drop a colony, she's trying to keep Kou from making it impossible for her to love him.

It's not actually a war, it's two terrorist attacks (the Naval Review and Operation Stardust). Also Nina isn't even in the military, she woks for Anaheim Electronics. You can't court-martial civilians

Aside from that, she didn't really affect the outcome of Operation Stardust at all, and really only prolonged Gato's life by a few minutes since he gets killed right after she patches him up. She totally is a bitch, though, but only in the normal way and not the "I'll provide valuable assistance to the enemy because PENIS" way that everyone on /m/ seems to think.

Gato was in the middle of trying to fucking drop a colony onto a planet!! There has to be some point where muh feels int's a valid excuse for this horseshit, and maybe she should have said something sooner, especially since the mission of the entire Albion was dedicated to chasing this guy down, and then trying to stop this colony drop, the same operation the claimed the life of a crew member. Shit, remember Luccette? Remember how she died so that the Albion could move on?

With Nina personally flying towards the colony and personally stopping Kou from at the very least, bringing Gato to justice? This sort of betrayal only comes up once in a moon. Not even Beecha and Mondo pulled this kind of dogshit.

I mean, she may as well have been a Zeon spy. Maybe the series would have been better if it turned out that she was.
