No, because "passable" is subjective (people have tried instituting "passability" tests for female bathrooms, but it was dropped because some cis women didn't pass) and I consider granting people more or less rights based on appearance to be unethical. As for the bathroom issue, I suggest that we keep male and female bathrooms for the time being, but add gender neutral ones that anyone can use.
