Holy shit how naive are you? There is no objective "upholding" of the Constitution, there's just two different schools, which (not coincidentally) match up with the two major political parties. Supreme Court judges just vote based on their personal opinions and justify it after the fact. We've seen it time and time again, throughout history. Scalia (who Trump apparently has a boner for) was especially guilty of this.
