Those factors are not guarantees to get the petition approved, only things that can be used in the hearing process for consideration on whether or not to approve the petition.

Let me preface this by saying that I am not in favor of this bill. That being said, did any of you actually read the text of it? The dumbfuck frogposting OP doesn't help our cause by saying controlled opposition shit like "This new anti-second amendment law permits government officials to order the confiscation of guns, simply based off of hearsay evidence. There is no actual evidence required to order this confiscation, and before the gun owner is even given a hearing" that is not actually stated in the bill and is easily refuted by the left.

What the bill actually says is that it allows for confiscation after a hearing in which the plaintiff is required to sign an affidavit or make a statement under oath, which is the exact opposite of hearsay. Additionally, the plaintiff has to support his/her petition with proof that you have a prior documented history of wrongdoing, be it drug use, DUIs, arrests for brandishing, convictions for violent misdemeanors, etc. Simply going to the judge and telling him/her that your boyfriend threatened you without any evidence is highly unlikely to get a judge to approve a petition for extreme risk protection.

If you plan on attacking the legality of this bill, you should be criticizing it based on what it actually says (for example, the assumption that someone who has previously made mistakes and repaid his debt to society should be forced to wear a scarlet letter for the rest of his life) rather than by spreading misinformation about what the text of it actually says.
