In an unprecedented move of ruthless tyranny, Oregon Governor Kate Brown has just signed into law a Democrat-backed document which allows the government to confiscate guns without any prior notice.

The law, based off of Oregon Senate Bill 719, has faced massive resistance from Republicans and Oregon citizens alike. Despite this, the local governments managed to sign it into law—Oregon is no longer a free state.

This new anti-second amendment law permits government officials to order the confiscation of guns, simply based off of hearsay evidence. There is no actual evidence required to order this confiscation, and before the gun owner is even given a hearing.

Worse yet, the only way for the gun owner to get his gun back is to file a case and prove his innocence. This is Orwellian, and it must be overturned by the Supreme Court; if this law begins being enforced, step by step, inch by inch, civilians will lose their second amendment rights.

Those factors are not guarantees to get the petition approved, only things that can be used in the hearing process for consideration on whether or not to approve the petition.

What the bill actually says is that it allows for confiscation after a hearing in which the plaintiff is required to sign an affidavit or make a statement under oath, which is the exact opposite of hearsay. Additionally, the plaintiff has to support his/her petition with proof that you have a prior documented history of wrongdoing, be it drug use, DUIs, arrests for brandishing, convictions for violent misdemeanors, etc. Simply going to the judge and telling him/her that your boyfriend threatened you without any evidence is highly unlikely to get a judge to approve a petition for extreme risk protection.

If you plan on attacking the legality of this bill, you should be criticizing it based on what it actually says (for example, the assumption that someone who has previously made mistakes and repaid his debt to society should be forced to wear a scarlet letter for the rest of his life) rather than by spreading misinformation about what the text of it actually says.

They would have to prove you are dangerous under the Oregon rules of evidence to a clear and convincing standard, which is between normal the civil burden of proof and beyond a reasonable doubt.

Sure it doesn't violate the 4th because its not criminal its civil but it actually meets all the parts of 4th for seizures. Its got an oath, description of the place to searched, and of thing items to be seized.

Most certainly not how that works. You can't use the guise of a civil suite to remove 4th amendment protections. The fact that the supreme court has not ruled civil forfeiture unconstitutional has no bearing on this, either.

You have a right to be secure in your documents and your property, only to be removed via due process of law. It is NOT that you have the right to get your property back via due process of law after they take it away WITHOUT due process.
