If you buy a brace and put it on a pistol just to skirt the NFA rules and plan on sholdering it then you are wrong. That's still illegal.
The ATF letter says that shouldering it doesnt immediately redesign the gun, and that occasional shouldering it is fine. But shouldering it every time is still against the law.

Nope, you just can't construct it with the intent of shouldering it. I could buy it because I liked the idea of shooting one handed occasionally, but shoulder it whenever I wanted to. I don't intend to buy it because I want to shoulder it, that would be intent to convert it to an SBR.

You're talking about the same agency that looked at a guys guns that were confiscated on unrelated charges, then said in court under oath that he had easily FA convertible weapons. When the defense called them on it they basically said a gunsmith have to basically modify the receiver and specially build a lightning link for it, which didn't fall under the definition of easily convertible, but he should still go to prison for being in possession anyway.
They could just charge you with constructive intent, seize all your shit through civil forfeiture, then once you've racked up 100s of thousands in legal costs they can lose the case and suffer no consequences while you're left picking up the pieces.
