Are frag round destructive devices? They really can't have more than a quarter ounce of explosive in them, especially the ap version. Could I BTFO the ATF an start a company to make something similar and sell them to civilians?

Says who? The ATF can ban whatever the fuck they want. Unless you're ready to explain why the semi auto USAS-12 is a destructive device but a Saiga is just a shotgun.

The ATF would just say that explosive projectiles, no matter what the specific type or weight of explosive material, has no sporting purpose.

the whole "sporting purpose" comes from the GCA where guns being imported must have a sporting purpose.

Current ATF guidelines consider anything less that 20mm small arms ammunition. anything over 20mm that is not a flare, smoke or fireworks are considered a destructive device.

Maybe read the laws. The NFA declared any weapon over 50 cal. to be a DD except those suitable for sporting purposes.
