Is it illegal for a tank driver to run over an enemy soldier in the heat of battle?

If a tank is heading down a street and an enemy RPG gunner jumps out from an alleyway and is taking aim, is the tank driver allowed to run that fucker over, or will he be charged with war crimes?

I don't think so. I knew a guy who was an M60 driver around the time the US was changing over to the Abrams MBT. He told me he was instructed to "use the vehicle as a weapon if need be."

No. Though odds are if someone jumps out in front of you like that the commander, loader, or gunner would just shoot them. Nobody wants to clean dead guy off the tank.

Pretty rare anyone ever gets close to a tank though, AAVPs and Bradley's ran a lot of people over in Iraq though.

Soldiers engaged in military operations are shielded from liability for things that would normally violate the laws of the nation they are in.

So a solider that runs a man over with a tank can't be charged with murder.

There's no regulation in the UCMJ that says a US solider can't kill an enemy with whatever is at hand, including a tank. The military at a whole is bound by treaty agreement not to use some tools as anti-personnel weapons as a matter of policy, but if a solider in the field uses them to kill an enemy it's not a legal matter.

No, tanks have used their tracks to collapse trenches and simply squish people in shallow ones, all done on purpose.

I don't know why it would be a war crime, it's not like you know who has a 20 kg shaped charge under a blanket in the trench...or something. And those guys in the trench, they are going to kill people if you leave there, in good cover.

Would YOU like to see your buddies die just because some purple-haired hippo back home said it's "evil" to kill people by burying them in their defensive positions? I sure wouldn't.
