I mean, I feel for the guy, but it's pretty hard to argue fair use when you're not commenting on or adding to the content in any way. You could make the argument for commentary if he edited the videos in such a way to make Nut'n look like a rambling, incoherent madman. Because, you know, that's trying to send a message that wasn't present in the original vid. Condensing a video down to a minute might be seen as sending that same message, but it's not as succinct. Look at someone like Crowbcat. His videos are other's intellectual property, but he can get away with it because his editing creates a narrative that sends a clear message.
