That was done on purpose op. The early mauser safetys had a habit of deforming, preventing the slot from lining up, rendering the safety useless unless you pull the cocking piece back.
Lots of the 93 actions have this modification. Its called a scalloped safety.
By all means you can switch it out, you'd just get to see what the armorer was trying to circumvent.

Thanks guys. I have a true gem in my hands, this thing is in excellent shape the bore is great and the receiver, bolt, and barrel serials all match. The only problem is the upper hand guard is wobbly. Any way to fix this?

Define wobbly. Upper handguards are typically loose as to not contact the barrel.
The contact point with the band is either worn down or was sanded if its excessive rattling

This is a commercial military model made for anyone who wanted a Mauser short rifle; foreign/domestic civilian, police, or military. It was may have bought by one of the German paramilitary groups prior to WW2 (like the Waffen-SS), or perhaps it was requisitioned from right out of the Mauser warehouse on the outbreak of war. Regardless it fell into the great Nazi German military machine, and unlike so many of these rifles managed to stay in Germany after the war ended (perhaps it belonged to a German police department all along and never saw any real combat). In 1951 the western Allies organized a border security force (the Bundesgrenzschutz) to combat smuggling between West Germany and East Germany; they were organized and equipped as light infantry. This rifle was still around, and went into service with the BGS.
It is specifically the Standardmodell carbine, with the turned-down bolt handle and side-mounted sling. The Standardmodell rifle had a straight bolt handle and sling swivels on the bottom of the stock.
