Let's say half the spergs on the police department that give a shit about ballistics are on the "muh gel testing/FBI ballistics research/IWBA/ammo capacity" side of the debate and the other half are on the "muh temporary cavity/energy transfer/power factor/one shot stop statistics" side of the debate

There's no 9mm load that will make both sides happy.

There are many many .40 loads that possess both good performance in FBI/IWBA gel testing, and good energy transfer/power factor/temporary cavity etc while not having crippled capacity like the .45 ACP.

Rather than making one side completely faithless in the administration deciding on a caliber they don't like, they pick a middle option that bridges the gap.

Also, .40 tends to have better gel test performance than 9mm when fired through steel or windshield glass barriers that one might encounter during a traffic stop or vehicle checkpoint. Not extremely important for CCW, but pretty important for state troopers/highway patrol/sheriff's deputies.
